Im still waiting for my senator to reply me back to see if I can find out the reason my husband was denied that way I will know were to go from here. Im at a stand still because I don't know what the co will write so I can't move forward now because of that. Has anyone else received update on their denied CR/1R case that has been sent back or on the Noid/Noir sent by uscis.

on 10-31-2016 I called my Senator office to find out if they had heard anything from the Embassy in Ghana I was told to hold on while she looked she stated it look like something was sent over the weekend which I believe it had been sent last week but she was not on top of things and never checked so if I would not have called to check seeing that it had been a week I might not have gotten the information on what the embassy said.

Dear Ms. Dieguez:

I have examined the interviewing officers case notes and see that she decided to return the petition to USCIS for review and possible revocation. This action followed the officers development of evidence that would convince a reasonable person that the claimed relationship is not legitimate entered into to evade immigration laws (9 FAM 504.2-8(A)(2)(5)©). When USCIS receives the petition and consular report, they will send the petitioner a Notice of Intent to Revoke (NOIR), and at that time the petitioner will have the opportunity to rebut consular findings.

Sincerely,

U.S. Embassy Accra, Ghana

My husband was denied in September 2015. The case was returned and reached USCIS in March 2016. It is now November, 2016 and we STILL have not heard anything from USCIS about an NOIR.

We have no idea about why he was denied. I used a lawyer, we submitted so much evidence, and still he was denied.

I contacted the Ombudsman, who in turn contacted USCIS. I am told it is actively still being reviewed by USCIS. So we've been waiting over the required 6 months since the case found its way back to USCIS.

What is going on at that embassy. We are a legitimate couple as are so many denied. What can we do about this? It's beyond awful and discriminatory. What other country do you see this type of behavior.
