evidence of the legal and physical custody for a child passport

Hi all!

My situation is that I plan to apply for my son's passport after I get naturalized as according to the Citizenship Act of 2000, my child should derive the citizenship from me. When we applied for IR2 visa for my child, the embassy accepted Biological Father's consent as an evidence of the soul custody. I am wondering if they accept it at the passport office. I don't have any court paper, only my divorce degree. As many of you know in Ukraine the courts don't normally issue any soul custody papers. My child does reside with me, on my US spouse overseas orders and goes to Department of Defence school. I can take an official letter from the school too. All I can submit is my ex-husband's notarized consent for the child to immigrate to the US, his permission to get a passport for the child and all other documents I listed above. Did anyone have to deal with it? I suspect that I will be turned away if I don't have the paper from the court proving my soul custody?

My ex-wife and I had no problem getting her daughter US citizenship. Only document we had provided was her ex-husbands notarized consent to leave Ukraine.

Thank you! I hope it will be the same for me. I read contradictory comments though. Probably it depends on a passport agent. Some people say that they were turned away as the passport office requested a proof of legal custody. The permission to get a passport and father's consent to immigrate didn't work well. Just trying to think a step ahead.

How old is your daughter?
