How to get married after my fiancee arrives on K1 visa :)

Hello everyone, I have a general question regarding how to get married on K1 visa in United states. What documentation will be needed by my fiancee before we go to clerk office to get married in Virginia. Anyone who came on K1 visa please share your experience what you did before you got married. I am just trying to understand what things we will have to do before we can go and get married. Any help is greatly appreciated.

P.S. Anyone from VA or other states who came on K1 visa. Please let me know did you apply for SSN before or after you got married. And will my fiancee passport and visa will be enough for us to get married ?

We just married in Georgia in September. All they asked for was a photo ID. He used his passport. They don't need the visa.

He filed for social security number within

2 weeks of arrival. He used his passport and I-94.

Go to the social security administration website, there you'll find what your soon to be wife need to bring in order to get her number.

Check your county's clerk office website to see the documents required to get a license, that's the first step. The ceremony will depend on your personal plans, find a officiant, justice of peace, whatever you want, and set a date and get married

First you'd want to start with the clerk of the court in the Virginia county the American fiancé resides. Look on the website for the requirements for marriage licenses or give them a call. In general both individuals go before the clerk, take an oath, and sign a form with their information. Some states have waiting periods, and some have requirements that you may only marry in the same county that you obtain the license in.

Once you have license, you can either choose to set an appointment to marry before the clerk of the court.. or you can take the document and marry before any officiant or minister licensed to marry in the state. They generally will sign the document and return it to the clerk or you can return it yourself. A few days of a wait, and you can then obtain official marriage certificate copies.

Yes we did obtain the SSN before the marriage (within two weeks or so of arrival but you can do this sooner provided your info shows up in the I94 database. check it upon arrival), but not actually before we obtained the marriage license (they didn't need to see the SSN anyway.. the passport sufficed). I would certainly recommend obtaining the SSN before the marriage, it's a lot less hassle. We married before our chosen officiant and she turned the license in very quickly. There was a 48hr waiting period before we returned to obtain our copies.

There's no order. Go with her, you just take her passport with her K-1 visa and her I 94 that you printed off the website and go to the Social Security office and fill out an application it's not difficult at all and there's not much to of an experience to share or you just go to the office and fill out the papers.

Same thing with the marriage license go to the county clerk of courts wherever you're getting married, take a photo ID, fill out the marriage license application and that's that. you can get married they are at the courthouse or you can have a little ceremony somewhere else. we had backyard ceremony at my brothers not much of an experience to share it took about 10 minutes very quick short and easy.

I think you believe it's more difficult than it really is it's very quick easy and simple.

While there isn't an order of what you need to get done first, I would strongly suggest you get your SSN within the 90 days before your I-94 expires. After that period passes you will need to wait until after you file your Adjustment of Status and get your EAD as they don't accept expired I-94s as proof of status. I have seen some people claim that they were able to get a SSN with their NOA-1s from AOS which I am skeptical about, but even if that is true there will still be a wait before you can get it.

As for getting married, yes definitely make sure to check out the county clerk's information. To be completely honest any advice about what you need that is coming from someone that isn't from Virginia isn't going to be too helpful, as the requirements vary state by state. A previous poster mentioned they only needed a photo ID, but for us we needed his birth certificate, and I needed my birth certificate, ID, social security card and proof of residency/address.

Guys one more question I have been reading stuff for her AOS package. I am not sure what is DS 3025 form. Is that the form thats in her do not open envelope cause I dont think my fiancee have this form with her? any suggestions?

If she doesn't have the DS-3025, she will likely have to go see a civil surgeon and have them complete a Form I-693 and corresponding physical. Take a look at the great pinned thread at the top of this forum page titled, Immunizations. DS-3025 or I-693, for more information.

I recall a similar question awhile ago about the marriage requirements in Virginia being discussed in the Welcome to the US and Your New Life in America Forum. Such topics are often discussed at that forum.

As far as sending the original birth certificate back, that is normal procedure when you apply for a US passport.

Talking about the marriage process itself, it's one of the easiest steps of the whole immigration and adjustment process. This because you can choose where to get married. If you want to marry somewhere where the requirements are easy means you will only need ID (DL or Passport), signature and pay the fee to get married. Places like Clark County, NV (Las Vegas) and Orange County FL (Orlando), just to name 2, will not require any documentation from previous marriages. It really is a very straightforward and can be a fun process.

What I would do is write down a list of places you would want to get married in. Then do a google search for marriage license requirements in the county that city is located in. Make it fun and an adventure if its doable for you. Good luck!!
