I-129F while deployed

Timeline

Hi everybody,

My fiance and I are starting gathering all the information and filling the forms to apply for a K1 visa.

In few days he will leave the US for deployment, and will be away for a while. He won't have a address to recieve things as he will be on a ship.

What's the best route we can go through this?

Will giving the power of attorney to his mother help?

Something so vague is not really helpful. What if your K-1 goes fast and he is still deployed and can't go to the US to marry you. What then?

Listen to Harpa. More info is needed and her example is a good one. What if you can't marry with the 90 days because he is still deployed? How will you explain that to immigration. Also, he needs some type of domicile in the US. Maybe his mother's house?

If you want help people here are willing but you will need to provide the appropriate info.

HI,

5 months actually gives you better options.

He can wait until the deployment is over and start the process.

Or

He can file the petition right before he leaves and hope that it gets approved while away. His mother can gather his mail and update him. If there are no issues you two will be able to continue the process upon his return. Note: There IS a risk to this. If the original petition is requires any Request for Evidence (RFE) he will be required to respond by a certain amount of time or the petition may be denied. If he is deployed and has limited or no access to mail he will not be able to respond accordingly.

So it is not possible for him to give his mother the legal rights to act on his behalf?

Not possible to give power of attorney to her. She can gather his mail and give him updates on the progress of your case but if they need, for example, a written letter that he is free to marry or if a document that requires his signature is needed she will not be able to do so on his behalf. That is why I mentioned the second option is a risk.

I suppose if there are things like supporting documents that don't require his signature (like pictures of your two together) she can send them.
