How long after an approval of an EXPEDITE Request?

Did anyone have their Expedite request approved on either I-130 or I-129F?

If so, how long does it usually take before the beneficiary can enter the US?

What is the process upon approval?

Once a petition has been expedited and approval, you still need to go through the transfer to NVC, to consulate, and to interview. You still need to request an expedite at the consulate as that is totally separate from USCIS. So when the beneficiary can enter the US depends on how long it takes for the medical/interview/approval.

Expedited processing will be granted on a case-by-case basis. Expedite requests will be considered under the following criteria: 1. Significant humanitarian concerns 2. Severe financial loss to company or individual 3. Extreme emergent situation 4. Compelling interest of INS 5. Service error 6. Department of Defense or national interest situation (Note: Request must come from official government entity and state that delay will be detrimental to our government)

Reasons to expedite a request must be stated on the optional expedite work sheet and should include a one-page support letter. To request that a case be expedited, mark the envelope with a red dot and use the street mailing address listed on page 8. Send via bonded courier or other overnight delivery service. Petitions and supporting documentation should be submitted in duplicate. PLEASE NOTE: only those cases marked with a —red dot“ will be considered for an expedite. NO EXCEPTIONS.

Expedites will only be granted for emergent reasons. Expedites are only approved by ACDs and will be granted infrequently. Cases that are not clearly approvable will not be expedited. Requests for expedited processing are normally acknowledged by mail within five days of receipt of the request.Normal processing will occur if a request for expedited processing is denied. There is no appeal from the denial of an expedite request. Follow-up faxes or telephone calls will not be entertained. FAXES TO CONSULATES Faxes to consulates will only be sent on request if the services are needed within 30 days and the petitioner indicates special circumstances or describes an emergent situation. Include an explanation of the need for the fax in your cover letter. The decision to fax will be made on a case-by-case basis. A request for expedited consulate notification must be filed at the same time the application or petition is filed to avoid the fee for filing Form I-824. A fax will be sent for consulate notification subsequent to the approval of a petition by submitting a properly filed Form I-824 with fee. notification of consulate requested. (Only in expedite and/or for emergent reasons.)

I do not want to be the wet blanket on this but I really hope you are not getting your hopes up for an expedited petition. Basically unless you are dying, they will not expedite the petition. I was looking into this as well for my own circumstances and was basically told by USCIS that I didn't qualify.

By all means try it (the worst thing they can do is say no!) and if you're successful please let us know.

I'm not dying (I hope!), but I have an injury to my spinal cord, and about to undergo surgery. Meanwhile, I am on bed confinement and on heavy medication. I called USCIS and they said that my situation DOES warrant an expedite request.

I was also wondering, if an attorney might help in this case, or is it even necessary to have a letter from an attorney accompany my letter and the doctor's statement?

One of the criteria for a USICS expedite is "an USCIS error". USCIS approved my 5 yrear-old daughters I-130 petition but then lost it before it got sent to NVC. I am assuming that qualifies as an USCIS error?

I don't think they'll expedite it. There is a couple here who filed for K1 (Amy & Brian) from Canada. I believe that CSC lost the approved petition and it took months for it to be found and transferred to NVC. See their timeline: http://www.visajourney.com/timeline/profile.php?id=19923

When did you send the expedite request? It should not take weeks to hear something. If you haven't heard anything, you might want to contact your senator's office to ask them to make an official inquiry.

vjb, service centers rarely admit to error and rarely expedite due to error although one poster here on VJ swore that Vermont expedited his petition due to an error. It's worth your trouble to try, but I wouldn't get your hopes up.

I submitted an expedite request for an emergent medical condition too, but not until the consulate stage. I faxed my request to the consulate then called them 24 hours later to find that the request had been granted and was given a medical appointment date and interview date.

They received both expedite requests for I-130 and I-129 on 4/4/07. I just called, and they escalated the call to a representative who said that she's never heard of an expedite approved within 3 days. She said that they will consider the situation, and it may even take MONTHS! for an EXPEDITE to be approved!

:blink: Then what's the point of having expedited service?! Aurgh! I'm sorry you're going through this. I'm sure you must have had your hopes up that it would be a LOT faster than this.

I don't understand this..I am about to undergo a very complicated surgery on my spine, where they cut under the lungs and heart, and there is about an 80% success rate. I need my husband to be with me as I go through it, and there is no way to get through to USCIS!! This is TOTALLY INHUMANE. Even criminals get better treatment, - they certainly get visitation rights!!!
