can not get death certificate

the petitioner ex husband died - or so she believe- since he was missing for so many years , and for some reason she never got his death certificate.the reason she tell is because he had different names or whatever.she can not still get one ,so she says she can get a paper that states that she is single to the best of her knowledge and she says it's formal and she has used it when filing taxes to prove she is single mother.

SO my questions are :

1) is that a common thing; to not be able to get a death certificate for some one ?especially when he was your husband ?

2) can you use this paper instead of the death certificate when filing for k1 ?

Death certificates are usually held in the county courthouse / some are held by the state

but easy to get on a husband / just show proof of identity and marriage, fill out the form to get one and pay the fee

no where is is not normal to not be able to get this in the USA

In the legal system, there’s something known as death in absentia (also known as presumption of death). This is a legal ruling that, despite the absence of a body, a person is presumed to be dead.

What Does a Death in Absentia Ruling Involve?

Death in absentia laws vary from state to state. Typically, at least one of the following criteria must be satisfied before someone is presumed to be dead:

  • The person has been missing for four to seven years, those close to the person have had no contact with him and a diligent search has failed to find him, or

The person was exposed to imminent peril (such as an airplane crash or the collapse of the World Trade Center) and did not return

If a missing person falls into either of these categories, a petition can be filed asking the state to declare him legally dead. The state usually requires a public notice to be filed, officially notifying the missing person of the death in absentia petition.

If this guy had so many different names then it's possible he just left, made up some more names, and did not die.

is she allowed to get engaged while in the divorce process or she has to wait till it's final ?

Engagement in the US is not a legal term. It is just a promise and promises can be broken.

She can't file for the K-1 until the divorce is final though. But if he is not around, it should go fast... she'll probably have to put out some ads in the newspaper or something in an effort to contact him.
