I-864 Last Minute Question

Hi guys, I know this could be a common question but I'm kinda panicky these days as my interview is already in a week's time.

Situation is, we still have to submit our AOS to the embassy during my interview next week. 2013 and 2014 my husband's total income is above the poverty line but his income last year (2015) was very low since for the last 5 months last year he has worked here in Kuwait and did not include what he's paid for in his tax returns. This year, he's back to the US and his total annual income should pass the line. In this case, do we still need a joint sponsor or could we just submit a letter explaining the situation? :unsure: :unsure: :unsure:

You will need a letter from his employer stating his current annual salary and that he is permanently employed.

Wait! Did you write that he did not include his Kuwait pay on his 2015 tax return? If so, he'll need to amend his tax return - because that's not right.

You will need a letter from his employer stating his current annual salary and that he is permanently employed.

Wait! Did you write that he did not include his Kuwait pay on his 2015 tax return? If so, he'll need to amend his tax return - because that's not right.

OMG! They didn't include that coz if I'm not mistaken his accountant said that it's not necessary! ?

I had him asked from his employer the below, I remember grabbed this somewhere here in VJ.

(Name) has been employed by (Name of Company) in the position of (Name of position) since (start date of employment) with an annual salary of $00,000. This position is permanent and not temporary.

If you require any further information, please feel free to contact me.

Yeah, that's the type of letter you'll need.

I don't know your specific situation. Usually, foreign earned income needs to be reported to the IRS. However, I'm sure his accountant is on top of it.

If it isn't difficult, it isn't worth it.

I don't know your specific situation. Usually, foreign earned income needs to be reported to the IRS. However, I'm sure his accountant is on top of it.

Thanks anyway. I just hope that his signed explanation letter and employment letter would be enough to support. If not we had his step-dad signed an I-864 too as he's willing to help. I should have all these papers by Sunday or Monday.

Hoping the embassy won't ask for a joint sponsor coz I want to avoid it as much as possible.

If you are submitting a letter be sure to have most current pay stub if its year to date just the most recent, if they aren't last 6 months.

Also have a copy of his 2015 tax transcripts with you just in case.
