I had interview last year 23rd November 2015 and so far no decision. I apply for greencard on i130 marriage base any idea whats holdup i had removel case open on me too so till next yr march if i dont get my gc i ll be deported

I had green card before for 10 year then i had 1 misdemeanor thats why i was on removal process. So i got finel court date in march next yr but my lawyer apply for new gc since old one was cancelled. Me and my wife went for interview on 23rd November 2015 they said you ll get your decision in 3 to 4 weeks but since then we are still waiting for decision

You got married to a USC after you are already in removal proceeding?

And what kind of 'misdemeanor' ?

Legal permanent residents are at risk of being deported if they are convicted of either what is called a "crime of moral turpitude" or an "aggravated felony.”

After became permanent resident. I had "crime of moral turpitude. Credit card fraud.

I was married and got my gc when i came to usa and then within 1 year my friend call law on me so i can be deported now i can be deported next yr in march. But my lawyr said since i have only 1 misdemeanor i am able to apply for new gc. And we did now i am waiting for my gc decision. Its been 11 month sincemy interview. And so far no decision.

It sounds like they're going to hold off on deciding until they figure out if you're going to be deported in March.

There's no reason to give a green card to someone who may be removed from the country.

Most likely they're going to wait for the out come of the immigration court case to give the final yes or no.

Still confusing information.

You are married to a USC spouse, then you moved over to US on spousal visa. Hence you got a green card?

Then you are put into removal proceeding because of credit card fraud.

Your lawyer advised you to file for a green card I-130 again with the same USC spouse? Or a different USC spouse this time?

So, did they take your green card when this case happened, or did your 10 year green card expire AND then this immigration case happened.


Things aren't making sense, and we can't help you unless you clarify.

When did you come to the US?
When did you get your FIRST green card?
Did your first green card expire, or did they take it from you?
How long were you WITHOUT a green card?
Did you commit this credit fraud while having the green card?

I got married to usc in 2005 i came to usa in 10 dec 2008. I received 10 years gc. And within 1 year time i committed crime. Which make me deportable.i had so many court dates i was in immigration detentions for 5 month. But i got out with bond. I was never without gc my lawyer cancel old one and apply new one becouse i have a family here in usa my son my wife and had only one case. Thats why i was allowed to file for new gc

How hard that could be to understand. immigration and custome enforcement took my greencard the time they arrested me. Got it. They kept me in jail for 5 month then i got out with bond. My lawyer suggest me i am married to USC and have one kid thats why i can apply for new green card. So i give up my old one. My master hearing was in 2015 February 15. Before that my lawyer apply for new green card and took the recipes to court and he told jadge that ' we applied for new green card and we need new court date. Jadge said ok if uscis approve your new green card then your case for removal will be closed. So since February 2015 i am waiting for my new green card. I know 3 other persones who apply aos and field office norfolk took 9 months 11 month and 10 month to each case i was hoping if that is the case then mine should be approved by now but still no decision.
