What do you have to show that you were told you were OK?

Should have gone home and waited to see if you got a H2B. Agency should have filed it properly and in plenty of time.

Sounds like you have been out of status for 5 months and working illegally, 6 months and you have a 3 year ban. Any future non immigrant visa sounds unlikely.

I see so my best bet right now is to take a risk and tell the truth whenever I reapply next year - since I'm the only one who can explain the situation? I'm scared that the consul / embassy will just ignore me if I try to explain my side.

General rule is to only answer the questions asked and then to do so truthfully.

Thank you for the information.. How about regarding the filing of documents for change of status? Is changing of status during " grace period " is really allowed? It is because my concern is I've read some articles over the internet and some said that it is allowed, and some are not.. if you have an idea can you advice?
