For anyone who has entered non a k1, and completed the AOS, I just have a couple of questions:

1) how long did the AOS take before you got your residency

2) did you apply for an EAD so you could work while you waited for the AOS? If so how long did that take? Ive heard the EAD can take longer than the AOS, so you're essentially just paying for nothing.

Any input would be greatly appreciated, thanks.

My AOS took almost a year. I did apply for an EAD at the same time since it was free if you would do it together. So why not? I got my EAD in 2-3 months.

It really depends. Some take 4 months, some take 8 months, some take more than a year.

EAD is free when filling with AOS, and it takes around 90 days to get it.

Fill in your timeline and you'll get an estimate on when you'll get the EAD.

EAD usually comes between 60-90 days from when you file the AOS. (EAD if free when filed with the AOS).

The AOS depends on a lot of things like RFE, interview- no interview. Some offices have a 1 year wait for an interview.

EAD doesn't take longer then the AOS. AOS (Green Card) will take over the EAD so if the GC is approved then you don't need the EAD.

That's great! My fiance will be coming over and with the applying for the EAD, I wasn't sure if the AOS had to be GRANTED/COMPLETED with it/first.
So apply for the EAD with the AOS - and receive the EAD generally within about 3 months we're estimating? That's what qualifies him to work WHILE the AOS processes correct? When AOS is granted, then that's when you apply for the extension on ability to work on the EAD???? That part I'm confused on. Thanks.

EAD adjudication estimate is 3 months, yes, and qualifies your then husband to work while he waits for his AOS to be adjudicated.

The good news is once his AOS is approved, he does not need the EAD anymore. The Green Card is his resident card and grants him the right to work and travel :) so there will be no more paperwork for you once his AOS is approved, until you file for the removal of conditions 2 years later.

Hey! This topic is super helpful, but I didn't know it was free to file the EAD when filing the AOS so of course I missed that part and just filed the AOS! Is there a cost if I file the EAD while the AOS is already processing?

Thanks for your help!

It's still free. When you apply, make sure to include a copy of the I-485 acceptance letter so they won't send it back due to the lack of payment. Same goes for the AP.
