Hi there

I am an American citizen having lived in Korea for over 10 years right after graduating from my university. My wife who is a Korean citizen and I are currently still in Korea waiting to obtain a gree card. We have been approved of the petition and now on to the next step of the process. My brother will be my joint sponsor. Now my question is, what are the steps to go about this Affidavit of Support I-864?

I know that I have to fill out the form and all, but who needs to get the tax returns and if so how many years? 3 years? I know that my joint sponsor will need his tax returns, but will I as well since I am the petitioner of my spouse?

If I want to get my tax returns, what is the easiest and possible way of doing so?

If you guys could get back to me on this, I will really appreciate it!

How did you file your taxes? Did you get any kind of acknowledgement that they were filed when you did?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As the petitioner, you are also the primary sponsor on the I-864. You will need to attest that you filed US tax returns for the last three tax years and provide a complete 2015 tax return or tax transcript. If you did not file a US tax return of any of the last three years, then you are required to provide a valid excuse as to why you were exempt from filing.

Living and working abroad is not a valid excuse to not file a US tax return. US citizens are required to report worldwide income even if there is no US income. Reporting is not the same as owing taxes. With the foreign earned income exemption of $90,000/year, you are unlikely to owe any US taxes.

These could be dumb questions, but I am clueless! If someone can save me, I would deeply appreciate it. What is the easiest and fastest way of getting your tax returns/tax transcripts when in Korea? Step by step if you can=)


Also, I haven't filed my taxes in America for over 10 years as I have been working in Korea. I did file taxes in Korea though. How do I go about this? Do I just file the past 3 years according to obtaining a green card for my spouse or do I have to file all the years I have been in Korea? Where should I file my taxes? Online?

You just need to backfile the last three years- you won't need to pay anything to the IRS as you will be filing as a non-resident, but do need to file.

I am not sure on the how to obtain proof when you are abroad; if you file via a tax preparer back home, they could send you the tax return, as I am not sure the IRS would send it abroad. Otherwise, perhaps you can file online with some place like Turbotax?
