Timeline

Received an RFE so wish to be very diligent with the next steps to ensure I’m not leaving anything out. :-) I’m preparing to send the completed I-134 form and evidence to my fiancé in Australia. I’ve read through the instructions for Form I-134 Affidavit of Support and Form I-864 Affidavit of Support Under Section 213A of the INA. I’ve looked for consulate-specific 1-134 information with self-employment for Sydney but haven’t found anything yet. I just wish to know if I’m understanding correctly.

I’ve been self-employed for the last 13 years and have income over 125% of the the Federal Poverty Guidelines for my household size, which will be 2 with my fiancé. I do not require the Use of Assets to Supplement Income to meet those guidelines.

Questions:

1. Can I leave the following questions on the I-134 blank? If not, which am I required to complete and is there evidence required to support each?

  • DOES NOT APPLY I have stocks and bonds with the following market value, as indicated on the attached list, which I certify to be true and correct to the best of my knowledge and belief: $

2. If my fiancé goes to the interview in Sydney with the completed I-134, my full 2015 tax return and transcripts from 2013-2015, is that sufficient?

If not, can I provide bank statements for some period of time for A or does it have to be a statement from an officer of the bank? If I provide statements, how long? 1 year? B and D do not apply to me. And with regard to C, my small business does not have a report of commercial rating concern.

From I-134 instructions: Submit in duplicate evidence of income and resources, as appropriate:

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:

1. Date account opened;

2. Total amount deposited for the past year; and 3. Present balance.

B. Statement(s) from your employer on business stationery showing:

1. Date and nature of employment;

2. Salary paid; and

3. Whether the position is temporary or permanent.

C. If self-employed:

  1. Copy of last income tax return filed; or 2. Report of commercial rating concern.

D. List containing serial numbers and denominations of bonds and name of record owner(s).

Timeline

Just to follow up on this post: I put the balance of a savings account, the real estate and that's it. No statements from any officer of the bank or other financial institutions, no statements on business stationery, and no reports of commercial rating concern. I provided tax transcripts for 2015, 2014 and 2013, the full tax return for 2015, and 2 recent monthly bank statements for my business account. They kept the 2015 transcript and the bank statements and returned the rest. There were no financial questions in the interview at all.
