My exwife (we married in 2002, divorced in 2005) has been married/divorced once after me... Had a baby in a live in relatiinship 2 years ago.

However she works and has never contacted me for support in the last 10 years even though I am on the hook with an i-864

I'm not aware that she has had any public assistance during those years.

I am wondering if during the application of a K1 visa in 2016 if anything from that last relationship shows up.. and if so what could be the results? Could they deny me a new k1 if they found out that my ex went on food stamps during that time? She has told me that she has not... But I am wondering.

Or would they just have me on the hook for two women now?

I make well over the 125% threshold.

Sounds like it's been more than ten years since you file the I864 for your ex? If so, you're no longer responsible for her. If she has had any misuse of benefits during that time, you would be in debt to the government, but sounds like the chances of that are slim.

On.another note, make sure your fiancée knows all about your previous relationship. It might be asked about at her interview.

If it isn't difficult, it isn't worth it.

You will list the ex wherever it asks on the forms. The I-134 will ask about previously filed petitions and affidavits of support too.

The ex would be counted in your household size unless she :

1. Becomes a U.S. citizen;

2. Has worked, or can be credited with, 40 quarters of coverage under the Social Security Act;

3. No longer has lawful permanent resident status, and has departed the United States;

4. Becomes subject to removal, but applies for and obtains in removal proceedings a new grant of adjustment of status, based on a new affidavit of support, if one is required; or

5. Dies.

Absolutely, having sponsored before doesn't preclude you, and that marriage is so long ago, it isn't a red flag either.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just to clarify, reaching 40 quarters of work might take more than 10 years.

Ah - thats what I was looking for....

So to verify - I MAY at worst be on the hook for my ex still... but they will not refuse me to marry my new fiance on a K1 visa...

If they find my ex went on the public support - will they notify me with an RFE or something? Or just stamp "DENY" or just tell me "FYI - hey sucker you failed the first I864"

Im just curious as to how that works.

Congratulations!

You divorced her and she remarried. You shouldn't be responsible for her since it has been over 10 years (2002 to 2016 =14 years). Public assistance won't be an issue.

You have the right to bring your new Fiance on a K1, but just be sure that she knows about your previous marriage(s) and can answer any questions they may ask her at the interview

Be sure to answer honestly on all the forms relating to your previous marriage(s) and I864. You may want to dig up all your old paperwork now and get refreshed with the proper dates.

You divorced her and she remarried. You shouldn't be responsible for her since it has been over 10 years (2002 to 2016 =14 years). Public assistance won't be an issue.

You have the right to bring your new Fiance on a K1, but just be sure that she knows about your previous marriage(s) and can answer any questions they may ask her at the interview

I *ABSOLUTELY* love talking to you - you are such the optimist.

My exwife is desiring to get her citizenship soon on her own....

She does not have the original dates/paperwork... the lawyer doesnt either because he disposes of all cases after 7 years.

The only thing I can do is select "Yes - I have filed another I-864 for someone" and explain that I have no dates other than general years.

The USCIS should have access to all this information given the names of both parties. Not to mention my ex is not to happy about helping me with someone elses paperwork . :-)

NOT to worry,, I was married 2005 and divorced in 2015, remarried 8 month later in 2016,,to another Filipina, not even questioned during process, during k1 interview I was with my new then fiancé, now wife, and American c/o ask, why you got divorced? my answer, well same as many, marriage fell apart and incompatability set in. and it was a fault of neither of us. the co was fine with that and quickly approved the k1. my ex DID use assistance in the last part of the 10 years, which NEVER was questioned, the 10 yrs is now over. its as if it was as easy if I were not married before.. so in my opinion it was not an issue,, and my divorce was much more recent than yours. good luck

I don't know, I answered all the questions of my ex, like it asks, never heard a peep, like I said as soon as my divorce was final the very next day was when I submitted the k-1,, so if it was gonna raise eyebrows it certrainly should have,, but not 1 problem,, from the time that I mailed the k1 to the time we picked up her visa at Robinsons in Cebu it was just around 100 days. interview was painless, never a question. infact I was never asked for the affidavid of support at interview, only looked at a few pics, 5 general questions, some chit chat and it was over. your gonna be fine , no worries. by the way where u from,, I may collect that beer if all is well!
