Is the K-3 right for me?

I am a Canadian citizen living with my American husband in Canada. We want to return to the states. I have one son from a previous marriage and we are about to have a child of our own in a couple of months.

I understand that I need to complete an I-130 but i'm wondering about my son and whether i need to complete an I-130 for him as well? And i'm not quite sure how to approach the impending birth of another child. (I know that my husband as the american needs to complete the petition, but i'll be the one who puts the info together!)

Any and all advice would be appreciated.

I too am a Canadian married to an American. My husband has lived in Ccanada since he was 10. He has dual citizenship. He recently accepted a position in Texas and has left. I also have a son from a previous marriage. We filed an I-130 for myself and my son and a K3. My son was included on the K3.

My husband moved here in August 2004, funnilyl enough from Texas and we were married in September 2004. However, we were in the process of the canadian sponsorship process and underwent some difficulties and seperated in December 2005 when he returned to Texas. We reunited in July 2006 and started the canadian residency process all over again.

What form is used for the K3 is it the I129F?
