Maybe one of you has some guidance for me on this:

We bring the car into an insurance approved auto body shop as they are the best in the area anyway. They do the inspection/estimate. It is around 5k in damages. However, they told us to try and file third party with the other insurance company because our deductible is 2k and we don't have rental car coverage. We get a call from them today and they have yet to hear from their insured party, but they want to send an adjuster out.

So, let's say hypothetically that the other driver's insurance offers us a settlement of around what the estimate is, plus the medical and rental car, and let's say we accept this. What happens if the repairs end up being more money? I know if we continue the claim through our own insurance and pay the deductible out of pocket that they will cover the excess repair costs if necessary and go after the other company for reimbursement, but maybe not all of our deductible or any of it.

Do we lose any right to continue the claim through our own company if we accept a settlement through the other driver's?

Right now, it will be a month out from the date any repairs are even approved before they'll be able to fix the car, so it would be nice to get a move on it.

Let them send the adjuster and go through them. We had over 7k on the truck in damages and they paid it because the replacement value was still higher. They sent the truck to a shop of their choice and got the quote from them. If the repairs are more then they expected the garage will deal with them directly and they will know right off the bat. You won't actually close that part of your claim till the car is fixed.

Troph, you always go through the repair shop of your choice. They will contact the liable motorist's insurer. In your case, it's the other guy. That insurer will work with your repair shop.

The other option, you will go thru your own insurer, you pay the deductible up front. Your insurer pays for the rest of the repairs. Then once the liability is determined, your insurance company will recover your deductible for you, from the other motorist's insurer. then they will send you a check for that deductible that you paid. But this could take up to a year.
