On question 17 of the I-130, it says to "LIST HUSBAND/WIFE AND ALL CHILDREN OF YOUR RELATIVE."reading that alone makes me think to list my husband (non USC) and just him because he has no children.It says list husband....and children....of relative<--then thats not right.

On the instruction sheet I read "IF YOUR RELATIVE OR SPOUSE HAS NO WIFE OR CHILDREN - IN THAT CASE PLEASE WRITE "NONE". Not filling in properly could result in the return of the form to you and the delay of your petition."

this makes me think to write my name because he does have a wife, ME! But then again I'm looking at Visa Journey Example Forms and "John Smith" is married and he listed NONE....

this also makes me think to write none, because it is stated on the previous page who I am filing for, we are married ect. so in that case i need to write NONE!

I will be sending I-130 to Rome when husband and I return from our visit to the U.S. I thought I had almost everything filled out, I go looking over things for the 1,000,000,000th time, and again, I have doubts. My problem is in the way my brain is registering this question, im sure it's something very clear, I really don't want to make a mistake and would be grateful if you all could point out to me what it is that they are looking for. I'm trying to read in the manner it is written, but I'm not sure if I'm on the right track..... My vote is none....but then again....

Jan 17 2007.......I-130 arrived at Rome Embassy

Feb 23 2007.......I-130 approved

Mar 05 2007.......Naples recieved I-130 from Rome

Mar 21 2007.......NOA recieved from Rome by Fax

Mar 28 2007.......Interview Appt Date set for 8th May

May 08 2007.......Visa Approved, also our Wedding Ann!

Bree, I don't know anything about the example forms here so won't comment. I don't have my I-130 to hand, but I am almost 100% that I answered the question that is asked.

I'm (USC) completing the form.

My petition is for a relative (my husband).

My relative has a spouse (his wife. AKA 'me').

You've made me curious enough to look when I get home!

Here is my understanding of the question. Whenever a question asks list "xx/zz", it is asking you to list one or the other, not both. The question asks "list your husband/wife and all children of your relative". This means list the husband or wife of the beneficiary and all children of the beneficiary. It does not ask to list husbands and wives. If it wanted that answer, it would have used the work "AND" in between husband/wife.

Think about the purpose of the I-130 form for a minute, and you will come up with the correct answer. You are petitioning for a relative, which is your husband. Question #17 wants to know if your relative, which is your husband, has a wife or husband and any children. And husband/wife means current husband/wife not former spouses. Because if a couple is divorced they are no longer considered hudband and wife. That's all. Don't over analyze the question.

In your case, I would list your name, your relationship to your husband, your DOB, and your country of birth. Answering NONE is incorrect in your case because your husband does have a wife, and that's you.

Remember too, that the I-130 is used for other relatives (who would not be your spouse). This is just potentially confusing because *this* relative is *also* your spouse.

Sleeping on things made everything more clear. And scy's post confirmed my new and improved answer and reasoning. :star::star: New rule= Bree will not post after hours of pondering, I cause myself to much confusion.

I'm reading my initial post now, and feel silly,sorry all. :blush: why I thought I would put none at the end was the stupidest thing i could have put. I should have just stuck to my gut instinct and I wouldn't have changed my mind so many times. :star::star: So I MUST remember meauxna's rule= K.I.S.S. = Keep It Simple Silly... :blush:
