Since October filers started having an approval, I have a quick question about NVC step.

 

One of the documents we should submit to NVC is marriage certificate.

According to http://www.visajourney.com/wiki/index.php/NVC_Process "Gather IV Package" (documents that a beneficiary prepares),  it includes Marriage certificate. 

 

Does this marriage certificate mean the marriage certificate of me and my husband OR a marriage certificate of myself issued from my country?

 

In my country's official document, I am still single because I married in USA and we haven't reported the marriage to my country, South Korea.

Obviously no marriage record is shown on a marriage certificate of myself since the marriage wasn't reported.

 

So, I wonder if the "marriage certificate" means the marriage certificate of me and my husband or a marriage certificate of myself from my country.

Which marriage certificate will you submit? 

 

if anyone knows, please share your opinion.

Hey guys, I came up with another question which makes me a bit worried.

 

When I filed I-130, I prepared supporting documents based on this resource: http://www.visajourney.com/wiki/index.php/EZGuideSpouse

 

 I-130 Packet
   a. Completed and signed form I-130 
   b. I-130 filing fee ($535)
   c. 2 photographs (petitioner)
   d. Completed and signed form I-130A (beneficiary) 
   e. Proof of petitioner's U.S citizenship:
      Copy of U.S Birth Certificate, OR Entire U.S. Passport OR Naturalization certificate
   f. Proof of Relationship
      Primary evidence - Copy of marriage certificate
      Secondary evidence - Scroll to Bottom of the page to see a detailed list
   g. Copy of divorce decree of petitioner and/or beneficiary, if applicable
   h. Completed form G-1145 for email/phone notification

However, today I found another resource from VISAJOURNEY.COM :http://www.visajourney.com/content/i130guide2

which includes 

6. A copy of the intending immigrant's birth certificate along with English translation. (If in any language other than English)

 

Did you guys submit Beneficiary's Birth certificate and/or photocopy of Beneficiary's passport along with I-130?

Okay, so it seems like I failed for the first step....

Do you guys know how long the reassessment process takes (to get a request letter from USCIS for a missing document and get reassessed)?....

You will need to submit a copy of the marriage certificate that you and your husband received when you got married in the USA.

So, I originally thought that it was necessary to submit a copy of my birth certificate since our lawyer asked for a copy to submit with our I-130 but it's not necessary to submit it. That information is outdated. Some lawyers prefer to include it as it is the best proof of someone's identity/nationality. I also submitted a photocopy of the bio page of my passport/b1/b2 visa along with any stamps that I had from visiting my husband since that is proof of our ongoing relationship. I don't think they are absolutely necessary since USCIS doesn't list them on their own instructions.

NOA: 11/02/2020

Bio reuse: 12/30/2020

USCIS changed to "Interview Scheduled": 06/07/2021

Interview Date: 07/14/2021 Approved!

USCIS changed to "Oath Ceremony will be scheduled": 07/15/2021

Please, help me to understand this process. My husband is a permanent resident living in Texas for almost ten years. In October he sent his n400 and I130 for his daughter under 21 who lives in Brazil. According with what I read on the uscis official site processing, we should have received something about the I130 process by now, since we sent it in the beginning of October. The only notice we received was the NOA of receiving the application back in November,

Anybody could please help me to clarify? Thank you in advance!

Don't worry, if they need something from you, it means they are actively working on your case. Send them the missing documents ASAP and they will start working on your case as soon as they receive them. You'll probably have a decision in a week max, if it comes down to that...

Which service center is processing your husband's I-130? Some of them are really slow...and the actual processing time varies from case to case. There are some people who filed in July and August and are still waiting to hear from the USCIS. They say that their aim is to send you a response within 6 months, but since he filed in October it's at about that 6 month mark. Has he tried calling them and inquiring about the petition?

I submitted my U.S. travel record history that you can get from U.S. border protection whatever government official website. (If you enter your passport number, it show a record when you visited U.S.) Thus, I didn't submit the photocopy of my passport. Most importantly, the resource I looked up to prepare I-130 didn't include the photocopy of beneficiary's passport...

 

I've been looking everywhere on the internet like crazy to find a official checklist for I-130 from USCIS. 

And still searching for it... So much outdated information is out there and it was my mistake that I relied on the resource I found on visajourney.com too much.

 

But I really appreciate your reply SabRob. Your reply makes me feel a lot better.. I think I'll wait for Request for Evidence...

Oh, that's so interesting, I had no idea you could get your travel records on the CBP website! 

 

I wouldn't worry too much about the passport, even on USCIS' website, in their official instructions, there is no mention of it. The I-130 is mostly about the petitioner (proof that he/she is a US citizen or LPR) and proving that the relationship is real and that the marriage is bona fide. You'll need to submit a photocopy of your passport's bio page and another of your birth certificate during the NVC stage.

Thank you for your answer. I assumed it would be Texas since we are in Dallas area. He called last week and they said it would take another month and a half at least, which last month he called also and they said would be this month. :(

Yeah, It was really interesting to see all my U.S. visiting records in one page. 

It shows not only the date you were in and out but also the airport you were in and out.

It's spelled out pretty clearly on Page 6 (look at point #5). This is a list of types of evidence that can be submitted proof of bonafide marriage. It's not going to spell out the EXACT documents you need to submit but rather the TYPES of documents you must submit. For example, it says "Documentation showing joint ownership of property". It's sort of left to your interpretation on what EXACT documentation you should submit.

Yep that's the one! By reading it I understand that both the petitioner and the beneficiary must complete and sign the form, 2 passport style pictures of both the petitioner and the beneficiary taken within 30 days of filing the petition, marriage certificate and whatever else you might find relevant to prove your ongoing relationship. We sent in pictures of us, the proposal, our wedding, us with family members and friends, boarding passes from when we visited each other and that was pretty much it.

It should say which center is handling his case on the first NOA he got in the mail. It doesn't necessarily have to be Texas even if you live there because they are randomly assigned to different centers. Unfortunately things have been slowing down in the past months :(  sorry you've been waiting for so long, I hope you get a response soon!
