I just read on a Sept 2016 fliers board that Nebraska is approving cases from around Sept 20!! #fingerscrossed. Our case WS received 10/20 and has stayed in Nebraska the whole time as far as I know.

I think most of the approvals in september are for those who got transferred from NSC to other SCs. So less hope for those who are stuck in NSC like me :huh:

Mine was filled in 20 October and it's getting to six months now I haven't heard anything yet since I got my NOA1.

I pray they approved it soon

I downloaded an app called "USCIS APP" and everytime a user's case that is similar to yours gets approved everyone gets a notification. Last case approved by Nebraska that showed up in my feed was Aug 29 and I'm guessing they're working on early September now? Thought I'd share since I think it's a pretty useful app.

I have the app but I never got any notification I only see they are working on august 9 in processing times !

You must have notifications turned off then. If you open the app there's a bell icon in the top right corner, if you tap on it, it will show you real time updates from similar cases.

Please help.

 

I am an October 2016 petitioner as well. 

 

Without thinking much, I have managed to make a mistake on my Tax Returns; filing it as single (since she isn't here with me or have any status in USA). I was wondering how many of you guys have done the same, or if not what can you do to rectify it before it becomes a problem. 

 

Some forums suggest that I should file as Married, SEPARATELY; else this would cause a problem during the NVC / Interview stage? NVC Stage does require the petitioner's W2s and Last year Tax Returns. I am planning to Amend my return, but is this necessary? As fellow October petitioners, with the NVC stage coming up anytime soon, how have you guys prepared for this? Please please help by sharing your thoughts and shedding some light on my misunderstanding/mistake. 

 

I also thought about the possibility of doing an Amend on my return after she comes here and gets an SSN number. Right now I have to re-work the papers with TurboTax, print the parts and send it off to Federal and State separately. I have to put a dummy SSN for it to let me add my spouse and print the return, and then Whiteout the SSN sections and write NRA or Non Resident Alien. I do not mind doing this, but I have to white out and scan these documents for NVC soon as well and not sure how that will go with a Hand Written Tax Return. Would it look bad? fabricated?. Yes, I maybe overthinking this, but rightfully so as I've been tired of this long wait away from my loved one. I just do not want anymore delays or complications than there already is. 

 

Please share your thoughts.

Am in the same situation as u,but am not worried about it.On the I-9 form,the IRS states that if ur spouse is outside USA,write single,so I can argue with the CO about that,and besides before u are able to file as married whiles ur u need to obtain ITIN from IRS and it's a long process,so am not going to over think it.

I think it's better if you amend and file as MFS since you won't need an ITIN for your spouse. Filing as single could cause problems during nvc stage/interview, that's what our lawyer told us as well. Since I'm currently visiting my husband, I already applied for an ITIN at one of the IRS offices so we'll be filing as MFJ. Better safe than sorry, if you ask me. 

 

EDIT: Also I think filing as single when married might be tax fraud? Even if it's not an issue for the whole immigration process, you could risk being audited.

Yes exactly. When my husband (US citizen) filed tax return this year, we were also thinking about what to do with the marital status since I am in Canada. However, he claimed it as married and send out paper by mail because it may cause problem as tax fraud later. As you said, it's better safe than sorry. He did it not for CR-1 process  but for avoiding tax fraud at that time, and then it ended up helping us to feel relieved regarding to CR-1 process too.

That is the same thing I was thinking. I thought about applying for an ITIN #. How long does that process take? I filled as head of household (since I support my mom) so I don't think that would be too much of a hassle during the interview.  I also think that the Embassy should be aware of the US tax laws.  I think that the important part of the tax return is how much you make and if you can support the person you are bringing into the US.

It takes about 6-8 weeks. No matter how you decide to apply (either send your documents via snail mail or through an acceptance agent or if you book an appointment at your local IRS TAC) it will still take that long. We called our local IRS office in Feb and they didn't have any available appointments until April. I think showing up at their office (if your spouse happens to be in the US at that time) and applying in person is better because you don't have to mail them your passport. Otherwise, if they're not in the US, they can schedule an appointment at their local Embassy and get certified copies of their passport and mail it to the IRS along with the W-7.
