London and Affidavit of Support

Hi Everyone,

This is a great forum and source of information.

So our story, my US girlfriend is in the UK on a student visa, we meet through a mutual friend, fall in love. We plan to move to the US together when she graduates, etc.

OK, I'm proposing this Christmas and in early January we will file for the K-1 Fiance Visa.

When we return she's going to Law School in Oregon so obviously she isn't in a position where she can pledge financial support for me - in fact I'll be supporting her. I'll be selling my house in the UK and will have $300,000+ in my bank account at that time plus 6 years experience as a television producer and 4 as an IT consultant - obviously I'll be in a position to look after us both. So I read somewhere here (I think) that if your interview is in London and if you can show that you own a house you are going to sell and have a certain standard of education and work experience you can bypass the Affidavit of Support by being financially independant yourself. We can get her parents to sign one if it's an issue but at 35 I would rather not have Mom and Pop covering my ### - it's just a pride thing.

Can anyone let us know if they have been down this road and if what I read is correct?!?

Two more questions: We will apply in January 2008 - we will have to be in Oregon together in September 2008 for University term starting. Are we cutting it fine?

Also, I want to give my two kids the chance to move over there and will put them on our application - but they are in school in the UK at GCSE stage so they can't change immediately. Do they have to move at the same time as I do or can they join us later?

There is such a thing as 'self sponsoring', and it has been done in London before.

and yes, your kids can join you later if they are named on the initial petition. They will be included as a K2 visa and have up to one year to follow on, I believe. My son stayed in the UK to do exactly the same thing - finish school and GCSE's and he followed on nine months after I moved to the US with no difficulties.

3 September 2004 INTERVIEW IN LONDON SUCCESSFUL VISA APPROVED! MARRIED OCTOBER 16, 2004

ADJUSTMENT OF STATUS - 5 MONTHS

4 January 2005 - Submitted applications for AOS and EAD - 12 May 2005 Conditional Permanent Residency Approved - interview in Santa Ana

4 June 2005 CPR 2-year Green Card arrives in mail

REMOVAL OF CONDITIONS - 3½ MONTHS

8 May 2007 - I-751 sent to CSC - 23 August 2007 - Approved - Card production ordered

30 August 2007 - 10 year Green Card received

K2 TIMELINE (Stayed behind in UK to finish school)

28 March 2005 - embassy interview & medical London - visa granted

01/18/06 Applications for AOS/EAD sent - 03/28/06 EAD approved

4/3/06 - RFE for AOS - requested new medical and vacc supplement

4/26/06 - approved without interview and welcome letter sent

05/02/2006 - Greencard arrives in mail

03/14/08 - Petition to Remove Conditions mailed to CSC delivered - 7/2/08 APPROVED

NATURALIZATION TIMELINE (for myself and son) 5 MONTHS

April 18, 2011 - N-400 Applications Mailed to AZ lockbox

April 21 (received April 25) NOAs

May 12 - FP Letters mailed

May 16 - Received FP appointment letters for June 8 at 11am

August 1 - Interview - approved for Oath Ceremony - OATH CEREMONY 28 SEPTEMBER

Eli,

I am also trying to figure out the I-134. I have emailed the embassy and I can let you know their response if you would like. I am here in the UK with my fiance until his visa is approved. I have been travelling and visiting England for almost a year now so I am not too clear about the financial support since I haven't been working. My fiance owns several properties so we are thinking he will be able to self-sponsor, along with my parents sponsoring if need be.

I am sure that I am making this more complicated than it needs to be! It is pretty much the only thing I worry about for some reason.

10/18/2007 Sent entire AOS, EAD, AP package to Chicago

10/19/2007 Package received in Chicago- signed for by V Bustamante

10/25/2007 NOA1 for AOS, EAD, and AP.

10/26/2007 Check cashed.

11/28/2007 Biometrics appointment in Denver.

12/17/2007 EAD card production ordered!

12/27/2007 EAD card arrives.

12/31/2007 AP approved.

01/07/2008 AP received.

02/01/2008 AOS interview in Denver. APPROVED!

02/11/2008 Green Card received in mail!

Done until July 09' !
