Schengen visa with expired conditional green card and I-797

Hello everyone

My conditional green card expires in December but I have already sent my I-751 application and have received an I-751 extension..I have a Europe trip coming up in Feb so for that I'll be applying for schengen visa in Dec with I-797 receipt..can there be any problem with that ? Can they reject my visa ?

Also , will I be entering my expired green card # in the visa application or my I-751 receipt #

What are you trying to ask? Of course any country can deny a visa if they find you ineligible. The most likely scenario for a denial is a criminal offense, a la DUI, or for lacking travel funds. Generally speaking, an expired conditional green card alongwith the extention letter should be fine, but some (less-visited) countries or smaller airline staff are fickle. Costa Rica comes to mind.

Thanks.. Basically I wanted to know since I have an extension receipt of my expired green card and will be applying schengen visa using that , along with expired conditional green card , can they deny my visa

That's a very good question, but I don't know that you'll get an answer except by applying. My wife has a conditional green card and we just received her Schengen visa for a trip to Europe. There's a Schengen requirement for a certain amount of time remaining before expiration of your green card, I think six months after the end of your trip. If there's an expiration date on the extension then perhaps they will use that and approve it. If there's no expiration date on the extension, it may cast a shadow on what your expiration date really is. Whether your extension will be accepted is totally up to the country you're applying to. In my opinion, try calling the consulate and ask. Or as a last resort if they won't talk to you on the phone, get your visa appointment at the consulate and bring in all your docs. They'll probably tell you right up front yes or no. If no, you will lose your filing fee, but you will know for sure. Good luck!

(P.S., it took exactly one month from the interview to receive my wife's Schengen visa.)

Thanks for the heads up..yes I did try calling but didn't reach the exact person who could guide me..my extension letter does say that my conditional resident has been extended for one more year so I do have a expiration date .. When u said I should take an Visa appointment, u mean the visa interview appointment? If yes then isn't it true that residents can just mail their docs to the consulate and don't need to go for in- person interview?

You MUST appear in person to apply for Schengen visa. Not for interview - they collect fingerprints.

Most EU consulates have electronic appointment system, if not - just call them. Usually closest available dates are 3-4 weeks ahead.

Yes, in person. And yes, they did take my wife's fingerprints, but the consular officer went through the normal routine of checking to ensure each document was there, and to get explanation for any anomalies. It was a normal visa interview. Medical insurance and sufficient funds to guarantee return were prominent in the review. Because my wife's income is not large, we provided my income and bank statements as well to show we would not be stranded without money in Europe.

My wife applied to the French consulate in Washington, DC, and there was an on-line link at the Consulate web page for making appointments. It asks a few questions to verify you have read everything and have the required documents, then gives you options for the date and time you would like to come in for the interview. It sets your appointment, then you print out the appointment letter and bring it with to the consulate at the appropriate date and time. There were vacancies as early as a week from the date we looked. At the consulate it was amazingly fast for my wife, maybe a half hour from the time she walked up to the security gate. You MUST bring the appointment letter to get in.

Hello

So I have my schengen visa appointment soon but my green card expired recently..I jave received the I-797 extension but since I have heard schengen countries are very strict about having an unexpired green card so I was thinking i should also set an info pass appointment and get a stamp on my passport but I have also heard they take away your expired green card when u go for info pass

So what's the ideal scenario when going for visa appointment

Expired green card + I-797 extension

OR

I-797 receipt + I-551 stamp through info pass (but no expired GC on hand as they will take that away )
