I need help... my dad is applying for citizenship after being in the country for over 30 years as a permanent resident. About 3 years ago he got into a heated argument with his girlfriend and the police were called, he was taken in but there is no record at county courthouse of arrest. I know if we disclose the arrest we need to provide records of court disposition but there isn't one to provide... not sure what to do in this situation. Any advice or guidance that you can share would be greatly appreciated.

No he didn't do anything physical... so maybe there is no record... so should it be disclosed on his application? Or due to no record he will be okay of we don't disclose? Thank you

Read the wording carefully on the application but it probably says "arrest" if it does then no need to report. You can always pay for an expanded records search but your county records certainly would have had a record if there was one.

I believe he went to court and nothing ever came of a formal charge. And the courthouse shows no record of the arrest. Not sure what 3 years has to do with it... please explain what it wont' qualify for?

Because you have show good moral character for the lasr 5 years. Have the court house write a certify letter saying that there was no arrest record found. Also ask your date if the they book him when he was taken in. Did they took hes finger prints and pics
