So I am a United States Citizen, I filed for my husband in Feb 2016. My husband has never stepped foot int the USA. My file was talking long to get approved so I reached out to the heads of USCIS..

About 2 weeks later I get a call saying that my inquiry was received and I have to do a interview at my local office.

(Mind you the interview date was set for 3 weeks after out from the date I got the call. )

I went to the interview answered all the questions that the had .. Verified that my relationship was legit :luv: .

A week later I was notified via USCIS website that my case was approved :joy:Yippie :dancing:

I received the I797 and it says the below

" The above petition has been approved. The person this petition is for will be notified when a decision is reached on his/her pending adjustment of status application"

My concern is my husband is not in the US how can they be adjusting his status ??

I immediately called USCIS the tier 2 rep said he sees that my case went to the NRC( national record center) and he will submit a expedite request to review..

He created a expedite request

On October 4, 2016, your request to have your case expedited, referral number WK************OKL, was assigned to an officer for response.

On October 5, 2016, we sent a response to your request to have your case expedited, referral number WKD*********OKL.

On October 5, 2016, your request to have your case expedited, referral number WKD***********OKL, was completed.

So I guess i will get something in the mail about this as they closed it yesterday

I then made an Infopass appointent to speak with the local office to see whats going on ..

Rep there told me that the File was sent to the NRC and the I130 petition was sent to the NVC ( National Visa center) and this is a normal process I should not worry ..

I have been checking the USCIS site and case still shows approved so I called today got another tier 2 rep he told me something completely different story he says that the case did not go to NRC nor NVC he shows it went back to Nebraska service center as they have to review everything from the interview and they will send it to NVC.. Oh boy this is a nightmare :ranting:

He created a expedite request as well.

As of October 6, 2016, your request for us to review an administrative error on your case, referral number WKD**********MSC, is currently not assigned for processing..

At this point I just don't know what to do .. I don't want to reach out to the out to the big wigs of USCIS and delay the process any longer. :clock:

Has anyone heard or dealt with this before.

Okay, so an expedite request was the wrong thing to ask for, it should have been a service request. You can contact your local representatives (congressman and/or senator) to look into this for you. You can also contact the ombudsman to get information for you. Sometimes this happens where the file is sent to the NRC vs the NVC and you just have to keep after it until ti's sent to the correct spot.

I did not ask for the expedite request I just called to find out what was going on ..I will wait the five days to see what comes in the mail..

Unless you accidentally filed an I-485 form with the I-130 petition package, I have no idea why they are treating your petition like an adjustment of status. I have heard of petitions accidentally being sent to the NRC before when they should have gone to the NVC, but the fact you had an interview too when you just wanted an update? And are using it to adjudicate an adjustment of status when the applicant wasn't even at the interview? Very bizarre. Sounds like a lot of crossed wires.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
