Hello all!

My husband just got approved for his AP and we plan on going up to visit his family in Nova Scotia December 21st-28th. I heard that CBP can deny entry to anyone trying to re-enter with an AP. How frequent is this? What goes on for CBP to deny re-entry? Also, does he just need his AP and Canadian passport when we go and visit his family?

He won't be denied unless he goes on an international killing spree or something while on vacation. The only people guaranteed entry to the US are US Citizens. He will need his Canadian passport to enter Canada and the AP and Canadian passport to enter the US.

He won't be denied unless he goes on an international killing spree or something while on vacation. The only people guaranteed entry to the US are US Citizens. He will need his Canadian passport to enter Canada and the AP and Canadian passport to enter the US.

That sounds pretty reassuring then lol thank you dear.

Hope to help here? My Spouse from an African Country used the AP twice to go to Canada. It seems like a crapshoot on what happens. The first time by Air back at Toronto Airport, it was an automatic secondary. Waited for like 15 minutes, Then they just stamped his passport: Paroled Until etc...(what a word I thought. Sound like prison parole...). The second like was coming back by car from Montreal, in Lake Champlain. This one was a pain. Automatic Secondary of course, but what a lot of questions from the CPB officer. How did we meet, where does he live, what is my age. he got nervous and flubbed some answers. LOL

So she began looking up his information in the computer. She took 30 minutes, then asked where was the last I-94 with the parole stamp from Toronto? We both looked at her uncomprehendingly like she was from the moon LOL. She didnt believe us of course, and she felt all his passport pages for the staple marks I think.

She then stamped a new I-94 with Paroled until etc..and said welcome back LOL.

Dont mean to alarm but just dont get nervous like he did.

Just like with AP, Green Card holders aren't guaranteed entry into the States either. In June this year, I visited my home country for a week without my husband (he had no PTO and I was homesick). When I got back I got a few easy questions about where I was/what I was doing. The only annoying thing was the attitude of the officer. When I was scanning my thumbprint, my shopping bag knocked my hand sideways and he got so mad about it. Like, so mad. I assumed he was having a bad day and it made me feel better :)

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Thank yous for your help! Jake and I will be going up by car and it seems like we'll be pulled into secondary regardless of what we do. Thank you for the pointers :)

This is Canada specific, but the only thing I would add is to give yourself at least two hours to clear secondary and security preflight in Canada , particularly if it's the busy holiday season.

In Vancouver I was in secondary, and they told me every time I used it to give two hours at least and to not take how empty it was that day for granted. I said I had done so, and I got told "awesome, good for you!"

I have used it twice now, and both times I've been in secondary for 25 mins and 45 mins, and it wasn't busy on either day.

5/23/16: Biometrics

6/3/16: Ready for interview status on I-485

7/5/16: SR1 filed (over 75 days)

7/26/16: SR2 filed (over 90 days) - 96 days

Your husband will have to go through secondary as he will have to be paroled back in to the US with his AP card. This will consist of him getting his fingerprints done, pics and then they will stamp the back of his passport. It's fairly easy.
