Father is saying child cannot come to US

So we are a month away from the K1 interview.

Fiancée called father today and he says he refuses to let her go.

I don't see this resolving except by legal action.

Has anyone dealt with this before?

Anyone know a good lawyer in Russia to address the issue?

The child is 15. He rarely visits or send child support. The father/daughter relationship is barely there.

But there is some contact/support. He lives far away from child currently.

I don't want to take child from father.

Yet I don't want to spend 3 years waiting until the child is 18 for Fiancée and child to come to America.

I don't want Fiancée to come without daughter either.

What should I do?

You can try bribing the father into giving some kind of consent. But the consent would need to be 100% legal and official. Lawyers can help with this. It might be a waste of money to attempt a bribe without getting a lawyer involved first.

There is a list of lawyers available at the US Consulate in Moscow. Find a lawyer who deals with family law/immigration. Consultations are usually free. I don't have any experience with family law, but my experiences with immigration lawyers here has been great.

Well that certainly is an option to try but would really suck because it amounts to blackmail money and the guy could keep milking them for money because he knows he has the upper hand. Without the father's consent not much they can do unless the courts give 100% custody and parental rights to the mother. Another expensive option.

It's not on the website unfortunately. It's a physical printed list that they have there. Not sure how you could get a copy without going inside the Embassy and picking it up. There must be another way, maybe try emailing them or calling them? I'm actually in another city (SPB not Moscow). I have the SPB list of lawyers right here with me (picked it up at the Consulate here), but not the Moscow list.

I vaguely remember reading that consent is needed up until the child is 16 but I'm not 100% sure. You can ask a lawyer about that. When does the daughter turn 16?

I asked in my previous reply if the duaghter migrating to the US was mentioned to the father previously. You don't have to answer but if that is the case then the father may be going through a shock of finding out about it. Maybe after some time and some dialogue he may change his mind.

Better to first try to find out what his objection is about the daughter leaving. Could be he thinks he can make some money out of it.
