Indeed every case is different. A trend doesn't mean that all the cases follow the same trend. It simply means that there are enough similarities for a pattern to be noticeable. That's all I'm pointing out. Congratulations on your progress and good luck in the interview.

I heard from the an immigration attorney that the late October and November EAD processing was almost put on hold to try deal with the influx of naturalization paper work they got before the election.

Mine was a 19th October and i got the status change on the 11th January to ' Card being produced' & ' Case approved' But i also got my I 485 case approved on the 10th and that staus has changed to ' we mailed the card to you' . My EAD was processed through NBC (MSC) and AOS through New Orleans Field office.

Well there we go, thank you very much Bayoubrit. That sounds like a much more informed and palatable reason behind the obvious trend. I definitely knew something happened in October.

Congratulations on your approvals! Hopefully the rest of us will follow suit soon.

Yes every case is different. Just from this short conversation here between 4 people we have 4 October filers: 1 early October filer and 3 mid to late October filers.

Earlier October filers:

Alina

Quick response time between filing and NOA - less than 5 days.

Mid to late October filers:

EmpressBab

ltr

Aseirdlo

Longer response time between filing and NOA - more than 10 days.

That's all I'm pointing out folks.

I am very aware that every case is different. I'm just also aware that are certain similarities between some cases, some, that were filed around the certain date.

Similar thing happened with K1 petitions last year. Newer petitions were routed to California Service Centre where they were processed quicker than older petitions that were in a backlog at Texas Service Centre.

Some of us are a little more inquisitive; there's certainly more to this than, "Every case is different". That goes whatever the situation. We all know that every case is different.

Hey Alina,

Thanks for your input; I understand that early October filers received responses very quickly but for applicants from around the 17th of October through to the end of October, there has been a total shift in the speed of the processing of applications. I noticed yours was done in 46 days yet applicants from the second half of October have waited almost double the amount of time of yours with still no EAD! This is a general trend. Yes every case is different but the general trend is that our cases are taking much much longer. And the general trend is that earlier cases were approved much quicker. I am yet to see a case from the second half of October that was approved as quickly as yours for example. Yet there are a lot of cases from the first half of October and earlier that were approved quickly. There's clearly a trend and a reason for this trend. We just don't know what it is. And that's frustrating.

You also try to stay positive instead of using condescending language, "As has been said a thousand times to a thousand people..." Totally unnecessarily and certainly not positive :-) Empathy goes a long way. And it's free :-)

Thanks

I rest my case folks. My different case ;)lol

Cheers :-)

So I have a big problem. I made a service request when 90 days past and now I got an answer that they are not doing anything and my case is on hold because I haven't responded for RFE and they attached a copy of it and the letter with request for initial evidence is from November 3rd! I never got anything, it's the first time I saw it and they are asking for something I sent them with all AOS package (taxes of joint sponsor) and they also want a letter of employment with number of hours he works, how much money he earns and what he does. It's weird cuz at first they say my joint sponsor has sufficient income but I didn't provided any evidence (i did) and at the and they say based on what I sent he doesn't meet 125% of poverty guideline (come on - 200,000$ is enough). What's even more annoying is that when I was waiting and calling asking about my case they always were saying that everything is fine and I just have to wait, also their answer for service request i submitted after 75th day is that my case is within current processing time, it's under review and if I don't get answer after 90 days past them I have to call them/make a service request again! NO ONE ever mentioned that they want more documents from me and that they sent RFE!! Also my joint sponsor is away from the country till middle of february and on the letter it says I have to send documents they requested in 87 days (which is january 29th) and if not they my case will be denied!

Help me, what to do???
They ask me for something I sent them in AOS package and they never sent me any RFE till now when they sent a copy of it with an answer for service request.

F-1 visa/status, F2A category - child under 21 yrs old of permanent resident

AOS (i485, i131, i765) package received October 7th 2016

Biometrics appointment November 22nd but did walk-in November 16th

service request December 21st (75th day) - answer case within current processing time

January 6th service request online (91st day)

got answer on January 12th that my case is on hold because they sent me RFIE on November 3rd and I haven't answered yet...I never got any letter, no updates on website, when I was calling them no one told me that they are waiting for answer for RFIE, they kept saying my case is under review

january 26th USCIS received my answer for RFIE

March 10th EAD/AP approved

March 17th combo card mailed

March 22nd combo card received

From what I understand, the RFE for financial documents has a pretty standard format, so I don't think they are questioning your sponsors earnings, just need proof. If you sent what they are asking for in with your original filing, then you can just re-send a copy of that now. Maybe they don't believe that last years tax return is reflective of current earnings, so that's why they need a current employment letter. I'd contact your sponsor by email and try and get this letter asap to prevent a denial, or further delay.

You need a vary of proof that he does meet the requirements. Proof such as employment letter stating his current position, hours a week, annual income. Pay stubs, give them six months worth to show he has a good income. Bank statements, etc. Gather everything you can asap and I hope you can email him.
