Also, RFE's during AOS can reset the clock for your application, in case anyone wants to know. For me, it's just finding out now if the actually reset it or delayed or I'm lucky.

The clock will also stop if USCIS issues a request for initial evidence pertaining to the principal application/petition that serves as the basis for your application for employment authorization.

  • For example, if your eligibility for employment authorization is based on a pending Form I-485, Application to Register Permanent Residence or Adjust Status, and USCIS issues a request for initial evidence pertaining to your Form I-485, the clock for your Form I-765 will stop when USCIS issues the request for evidence and restart when USCIS receives the requested information.

01/13/2016: I-129F filed  07/15/2016: K-1 visa in hand
10/13/2016: Filed AOS + EAD/AP.   07/07/2017: Permanent resident (Conditional)
04/16/2019: Filed ROC  11/17/2020: Approved. (10 yr GC)

I just got a message from USCIS; new card is being produced. My case was active for 84 days. So yeah, the wait was beyond exhausting and literally dragging but we all have to hang in there. Here's my timeline:

Oct 4 case was received

Nov 18 Did my Biometrics

On my 76th day, I filed for a service request online

Dec 28 received notification of production for the new card

Case is being worked by National Benefits Center

I was on F1 visa and did concurrent filing

Apparently that's not the case anymore. I had a request for initial evidence for I485 (birth certificate for joint sponsor was missing). I called USCIS to ask if the timeline for my I485 and other cases would be reset or delayed. She said that it would only affect my I485, it would be put on hold until they received the evidence. The I485 is ironically the only case so far for which I have received a status update.

10/04/16: Package (I485, I130, I765, I131) sent to Chicago Lockbox via Priority USPS

10/05/16: NOA1 Package received

10/18/16: Hard copies received

10/26/16: Appointment letter for Biometrics

11/01/16: RFIE: birth certificate joint sponsor missing

11/08/16: Biometrics

11/22/16: RFIE received

12/14/16: I485 Case is ready to be scheduled for interview

12/19/16: Service request for I765 (day 76)

12/23/16: Letter in mail stating that I765 is within normal processing times

01/03/17: EAD card in production (day 91) later changed to Case Approved

01/03/17: I131 AP case approved

01/06/17: Card has been mailed (day 94)

01/11/17: Card in hand :jest: (day 99)

What was the reply on your service request? To me they sent a letter stating that everything was being processed and that if I didn't receive a status update within the 90 days timeframe I should call them. Did you get a letter like that?

No....just got a response same day that my case was assigned to an officer

The timeline visa journey said USCIS is processing 10/15 date I-765. Has anyone mailed before 10/15 get their EAD card?

I haven't gotten mine. Still waiting since oct 4

Ahhhhh as much as I want to jump into thinking this will be true.. the USCIS isn't called the misinterpretation line for nothing. I'm a little on the fence lol. Really hoping that what she said was 100% right but sometimes even the people you speak don't know what they're talking about exactly. Let's hope she's right!

Opened a service request and I didn't even get a email that it has been assigned to an officer or anything. Well this is frustrating I guess October filers didn't have the privilege of getting anything early. I did an interview today and I'm sure I would have been hired on the spot if I had the work permit. I told the interviewer about the EAD and he's foreign as well so he understood but he did say it's a position he wants to fill asap. So great. I definitely don't have the job. Why does it even take 90 days anyways? I have no RFEs or nothing. I'm really depressed now ??

Hang in there hon. I know exactly how you feel. I haven't started looking jobs as yet because I didn't want to be disappointed. And it's been really depressing sitting around not working.

January 5 will be my 76days Mark and the 19 will be my 90 days mark. It seems the closers we get the slower the time moves. Lol

I told my husband I just won't apply any where else. I done had to sit and wait so long it really doesn't make any sense I try. I understand the wait for the interview but if your going to ultimately give us the EAD why have us sit and do nothing and not contribute to the economy?
