K1 application USCIS requesting more evidence!

Timeline

My petition notice date is 18 July 2016, and on 15 Sept 2016, we received notice that they are sending Request For Evidence (RFE) to our lawyer. But we have not receive the letter yet (6 Oct 2016). What is the chances that our application will be denied? And anyone could tell me, what other evidences they may ask for?

There's always the chance that a petition can be denied.

There's so many reasons for an RFE it would be pointless and a waste of time to speculate on it until you know what it actually is.

Yeah, it's impossible to say what the RFE is for. But you're likely not going to get denied just because of an RFE. You might have forgotten to sign a form, include a document, etc. Maybe one of the documents you sent isn't accepted by the USCIS (for example, sometimes foreign divorce decrees aren't accepted by USCIS and you have to provide a different type of document). Maybe they want more proof of your relationship if you didn't provide solid evidence that you two have met within the past two years. These are just a handful of hundreds of possibilities. Just wait until you get the RFE, and consider asking your lawyer if he's gotten them yet.

And consider skipping the lawyer next time. They tend not to be too helpful and are often just middlemen that slow down the process.

What documents did you send USCIS originally with your application (pictures/communication evidence etc)?

30 Sep 2016 - NOA2 approval (no email, received letter on Oct 6)

13 Oct 2016 - NVC case number assigned (called NVC)

Lawyer requested pictures from both us, which, we did provide it to them. I am not clear about the communication log, most stuffs they required it from my fiancé(petitioner).

I have two questions, does age gap takes into account of the application? My fiancé is 36 and I am 24.

Secondly, I read about not to sign the documents with blue ink, is it true?

Don't worry about age (in your instance) or ink color.

An RFE is a golden opportunity to add extra information to your petition package.

First, of course respond fully to the RFE.

Then (your option), include more "evidence of bona fide relationship."

Cover this with a note that says, "For the Embassy."

USCIS will not care about this extra material, but they'll pass it along to the embassy.

The extra information might be helpful in the visa decision.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

Not sure about your questions although I think you age gap shouldn't be a big deal.

One thing you need to prove to USCIS is your attachment with your fiance which your evidence for that would be prolonged communication with her/him.

We have pictures but not much because we aren't the selfie type. I am still waiting for the RFE, lawyer called USCIS to re-mail it because we are supposed to receive it for now.

May I know how many days they will typically grant for RFE reply?

I think you should wait for the hard copy to come, then you'll know what's missing. RFE could mean anything so we dont know exactly until we get the mail. As for my case, our RFE contain 2 parts:

1. Provide circumstances of meeting to establish the relationship

2. proofs of meeting in the last 2 years

we sent our RFE response, and got approved 2 weeks later. So you shouldnt be worried. Make sure you provide what they ask for.

We didn't send our chatlogs& facetime calls. Now USCIS only have our pictures, hotel receipts, passports stamps. We should have taken this opportunity to include more evidence for the Embassy. Now I feel regretful for not doing so.

That's OK. Take it to the visa interview. Be on the premises or nearby during that event, if you can.

oh I'm the beneficiary :). Anyway, my fiancé will come back to Vietnam and join the interview with me. I heard doing so will increase chances to get the visa.

If you're the beneficiary, you'd probably better be there.

The petitioner might not be allowed in the interview itself.

However, give the CO his U.S. passport, to prove that he's on the premises.

If this doesn't add credibility, it enables the CO to ask questions that would otherwise require the submission of paperwork.

As far as I know, at Vietnam Consulate petitioner is allowed in the interview room, but is required to sit in the back. The CO will ask petitioner only if necessary. I've heard some people get denied without being offered a chance to present their evidence. That makes me worried a little bit.
