Almost 1yr since Filed I-130 + AOS

Its been almost a year since we filed back in OCT 2015 and we haven't gotten the Interview Notice yet. I been checking the status page every now and then and nothing has changed since beginning of this year in JAN 2016. We got married in Aug 2015, and sent paperwork out about a month or so later. She was coming from a student to work visa and was just running out of time on work visa before we filed.

Last know updates as follows from USCIS Status Update page.

Filed in Oct 2015

I-131 Approved Jan 2016

I-765 Approved Jan 2016 (Got Card in Mail and currently employed)

I-130 Received Oct 2015

I-485 Received Oct 2015

Biometrics and medical was done too.

Now we're getting worried since there has not been any updates for almost a year now. We're in the San Francisco Bay Area, and close to the San Jose Field Office so there could be a backlog, but have been many cases where others have gotten within half a year.

Any suggestions on what the next step? Can we walk into a local office and see if they can help? I tried calling them about the I-130 about a month ago, and they say they will put in a request to look into it, but all is quiet still.

Do a service request online to check on your case. (it's on their webpage)

I opened up a Case Inquire and marked my I-130 and her I-485 as outside of normal processing time.

Thanks for that, i would had missed that box on the status update page.

Hope that would push things along, or at least tell us where it's at.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So we got a response back from USCIS and its a generic response stating due to workloads not related to our case is delaying the process. That is pretty much it so far.

Also my wife's EAD is running out as it almost a year. What do we need to do to renew it? Do we need to pay another fee?

I Guess we should do the Travel One as well.

Sorry to hear about your situation. Ours has been sucked for more than 9 months now and we're still waiting. As far as the EAD/AP goes, you can still renew it with no additional fee. Not sure what the detail process is but I'm sure it's free and renewable.

You need to send out new ead and Ap packets to renew them and include your receipt notice for the aos in each one so the fees will be waived because of the pending aos application

Do we send seperate package or can they be combined into one? When we did AoS I think it was all in 1 complete package with multi packets inside. Each request is a separate packet yes?

you have to attach the same docs as you did the first time plus the aos receipt. They can be sent together in the same package, just make sure they're separated by paper clips.
