hello please help me...im john and i am an immigrant here in USA. and i arrived here last year. i left my wife-to-be and kids in the philippines.

i will be marrying her this year when i get back there. and now i dont know what to do next for i want them to be here the fastest way possible. though it takes time but i hope there's an option faster.

should i file for K3 visa for her when i get back here in USA? how long is that? whats the priority date for K3? or should i wait to be a US Citizen before i petition her? do u think its the same or wat?

Do you have your permanent residence? If so, you are only able to file the I-130 as the only option until you have your citizenship is the Immigrant Visa. And I'm afraid you have a few years yet until you will be able to apply for citizenship. The I-129F for the K-3 is only available to US Citizens. You are in for a long wait as well as you have to wait for a visa number to become available. You can file the petitions now as an LPR, when approved they will be forwarded to NVC. However NVC will hold them until a visa number becomes available. During the process when you obtain citizenship you will be able to update the petitions to that of a US Citizen.

Most Filipinos are pretty informed when it comes to the U.S. Immigration (they have become somewhat "expert" over the years - LOL). So it should not be hard for you to find some kababayans to talk to about it.

As a recent immigrant, you are limited to what you can do.

Most Filipinos do it this way: They go ahead and "make a family" under the "live-in" or "Common Law" method. After the spouse is petitioned by parents to come to the U.S. as an unmarried child then the Filipino immigrant just waits 5 years and becomes a U.S. Citizen. At that point, the Filipino becomes a "balikbayan" temporarily and goes home to the P.I. to marry his "Common Law" wife. After returning to the U.S. the Filipino then PETITIONS for his "new" wife and his minor children to join him in the U.S. through the USCIS Form I-130. After processing is complete the family can be reunited in the United States.

Well, if you came to the US last year, then you have a little bit more than 4 years left. I'm an optimist so I tend to look at things differently. ;)

I think if you petition your wife and children now it will probably take just as long for you to become a US citizen and then petition them that way. Becoming a US citizen is ALWAYS a very good idea, especially if you plan to live the rest of your life here with your family.
