I-129F October 2016 Filers (merged thread)

I'm sorry but it appears as if you may have sent the I-129F to the wrong lock box. Nebraska is for the I-130 but all I-129F's go to Dallas.

Don't panic though. They will simply reroute this to California Service Center or even to the Dallas Lock box if they have not returned it to you already.

However this will cause further delays but I would hope not more than a week or 2 for them to send it to the right place.

How long ago did you send the I-129F to Chicago?

AND

Did you send a copy of you NOA1 for the I-130 WITH the I-129F like it ask you to do in the instructions for K-3?

Form I-129F, Petition for Alien Fiancé(e): Next, file Form I-129F on behalf of your non-citizen spouse with the Dallas Lockbox after filing Form I-130. Include a copy of the I-797, Notice of Action, indicating that USCIS has received your Form I-130, on behalf of your non-citizen spouse. There is no fee when filing a Form I-129F for a non-citizen spouse (K-3). If your non-citizen spouse has any minor children seeking K-4 nonimmigrant visas, they should be listed on the I-129F filed on your spouse’s behalf.

didn't think about starting the DS-160...isn't that online? Since it is a US process I'm guessing most embassies have same or similar procedures for K-1 requirements.

Yup! The DS-160 must be completed online and is required for all non-immigrant visas (B1/B2, F1, K1, etc) so I'd imagine it's required regardless of which embassy you're using.

I sent it on oct 14, I guess, and yes, I sent a copy of my NOA1 for he I-130 with the I-129F.

Ok good to hear.

So at this point I think it is as I said before.

LIN - Nebraska will:

1.) Return I-129F to you for property mailing

2.) sent it to the Dallas lock box on your behalf

3.) forward it directly to CSC.

Not much you can do at this point.

Basically you can wait for I-130 to run it's course and in the mean time hope that I-129F gets worked.

This could get him here 2-4 months sooner depending upon how long ago you sent your I-130 and what stage you are at.

I'll check your time line now.

Review of the link above if you have not seen it already.

It list all the timelines for CR-1 through the various service centers.

You can find NSC there for times from NOA 1 to NOA 2 for the I-130 and it is 159 days or about 5.5 months.

You filed your I-130 basically beginning of Aug so it has been 3.5 months so far.

More than likely you will get your NOA 2 for your I-130 in the next 2 months.

Your I-129F once rerouted should be approved in about 1 to 2 months as well.

The K-3 Life Act was originally created to reunited married couples sooner because years ago it was taking 12-24 months for I-130 however processing times are now down to 6 months or less for NOA 2.

I'm not really sure if k-3 via your I-129F will really get your honey here any quicker but I guess it does not hurt to try.

Hi Cob821 AKA Derek. Welcome to the forum.

Nothing to be worried about for 3 really big reasons.

1.) Our fiancee's are both from the Philippines. Yes there is a Muslim element there but there is one here in the USA as well. The line above says "where vetting cannot safely occur"

The United States has had a presence in the Philippines for over 120 years. The US embassy has been safely vetting immigrants from the Philippines for years so I do not think this will be an issue.

2.) Our petitions have already been sent in. Trump won't have any control until January hopefully the interviews will already be scheduled before he has his furniture unpacked at the White House.

3.) The To Do list of Trump is the same with any President here. Just a list and many of these things never get done.

In other words I would not be worried one bit about OUR situations.

Now 1 or 2 years from now could be a different situation. The Presidents from both our country and the Philippines have said and done radical things so who really know.

Also if our fiancee's were from the middle east or certain parts of Africa then that would concern me more.

For the most part what ever our current or future president wants needs to go through congress for approval so it will take time regardless.

I don't want a political debate here. I wish our country the best no matter who is in charge.

For any other people worrying about the election:

- He will only start in January

- First few years will be re-arranging his staff

- Maybe late 3rd, early 4th year some changes will happen, but remember, any bill has to go through House (1st) and Senate (2nd), where it will have to satisfy both parties. Only then it will get to the President.

This is typical for any President, which is why you see most of Obama's initiatives came to life during his second term.

You have nothing to worry about.

Thank you for your reassurance! Off topic though, I haven't received our NOA1 hard copy which is weird 'cause I'm following Jim's timeline since it's so close to ours, plus the fact that we live in neighboring states. I think there might be something wrong with our mailbox and I'm worried for the NOA2 hard copy (when it comes, hopefully soon). Anyway, is it possible to change the mailing address even though I technically didn't move? I usually have my items shipped to my mom's place instead of my apartment, but I just set up our apartment mailbox after we received the NOA1 text/email.

I am an October filer. Sent 129F on the 25thOct and recd NOA1 email on the 28thOct. While reading this forum, I noticed one of the members on this thread did not mark "N/A" for the blank boxes non relevant to the case. And there are lots of them.

Is that reason enough for an RFE?

It can be 5-10 days. I would not be too concerned. You will likely have it by Monday if not Saturday (No mail tomorrow 1/11 and very little USCIS activity as well do to Veteran's day Federal Holiday)

Have you been receiving any mail lately at your mailbox?

Do you have a copy of the petition that you sent in, I would make sure that the address is correct that you gave them.

You can change the address if you want but it's taking on average 30-45 days for NOA 2 so they may approve your case before they even have a chance to match your address change up with your case.

If it were me I would just leave the address unless you are in a high crime area for postal theft or something.

Having said that is is important to note that the NOA 1 hard copy is not that important but the NOA 2 Notice of approval is and your Fiancee in Manila will likely need that during the US Embassy process.

So what ever your mail situation be sure to do what ever is need to get a hard copy of the NOA 2.

Anyone know the ryhme or reason/ process of uscis k1 processing because it does not seem to be by ordee received

Hello Lykesarah,

The California Service Center who processes K-1's has dozens if not hundreds of employees. The employees work not only I-129F's but a variety of other cases.

As our cases arrive from the Dallas Lock box they are given to an employee . The employee who has you case may have more cases or more complicated cases then the person who received someone else's file the same day. Different employees work at different speeds as well. That is the reason they are not worked in order. Their are many employees and cases are divided out between them all.

Having said that "generally" they are worked within a certain average time frame currently about 30-45 days on average.

Yes people here are getting RFE's for many reasons and one that I saw earlier this week was for failure to put N/A.

I'll review a copy of my I-129F that I sent in and tell you where I put N/A or "None"

Part 2.0 - info about your Alien Fiance(e)

10.a. Other Names Used - N/A

13.a. Name of Prior Spouse - "none"

15.a He or she last arrived (in USA) - N/A

16.a Child of Alien Fiance(e) - "none"

31.a. Fiancee's Alpha if other than Roman letters - N/A

Part 3. - Other info

1.a. _ Stationed overseas - N/A

I find it interesting that they are giving RFE for not putting "N/A"

Because in the I-129F Instructions dated 6/13/13 it clearly states on page 2 of 9

3.) If an item is not applicable or the answer is "none", leave the space BLANK.

I would say it is up to the individual reviewer of the case at the service center to make the call if RFE is needed.
