Maybe I'm missing it, but how do we know that the greencard was not issued and the ex didn't just throw it in the trash?

If did get a green card it was most likely only good for 2 years. After the 2 years GC then they issue a 10 year green card. Most likely even if he did get the 2 years he didn't go for the 10 as he would need proof they are still married etc. He's here illegal, working illegally, but paying taxes as he should.

I'm unsure as to the impact that it might have on being able to AOS through a new spouse if the greencard was received for the initial K1 spouse which is why I asked.

It might make things less complicated.

If he got a GC he would have lost it at ROC time by not doing ROC. If he received a GC and then filed ROC with a divorce waiver and got approved, he'd have no need to AOS now because he'd have a 10-year GC. Edited October 4, 2016 by EM_Vandaveer

It depends.

The question of the first marriage (if it was bona fide or not) would have to be resolved before he could AOS through a new USC spouse.
