Hi all,

When filing out AOS forms (I-864, I-485) can my US citizen wife put her married last name on all the forms?

Her tax returns, W2 and of course birth certificate are all in her maiden name. In addition, we are getting married in the state of Ohio. Our marriage license and the marriage certificate do not have a space where her new married last name can be put down and we would like to submit the forms straight after we get married so she will not get a chance to change her last name on her passport etc.

I have read many posts that say the marriage license and certificate in the maiden name is acceptable in cases for the wife as a beneficiary but haven't been able to find anything if she is the petitioner.

Should I just fill out all the forms with her maiden name? Is there even any benefit in filing out the forms in her married name since she is the petitioner?

Thanks for any advice!

You can use married. Her marriage cert will be proof of name change (if elected). You don't need to have a box for new name in order to change the name.

I did

I had all my paperwork under my single name and when i got married I used my husbands name for the AOS (I am the US Citizen) their was no problem. It is obvious name was changing. I as well changed my name in the Social Security office ASAP as soon as i got married.

AOS approved 02/12/2014
ROC approved 09/14/2016

DIVORCED 01/10/2020

I'm also the USC and took on my husband's name and I'm filing all forms with my married name. The marriage license is the only proof of my name change.

1/17/2019.........Mailed ROC package via USPS, two day shipping to Dallas, TX

1/19/2019........Package delivered

1/22/19............Case Received

1/28/2019........Received text from USCIS with case received information and receipt number

1/28/2019........Bank check was cashed 

3/4/2019..........Submitted e-request for non-delivery of receipt notice

3/15/2019........Received email confirmation that a duplicate receipt was in its way

3/23/2019.........Received 18 month extension letter in the mail

7/5/2019...........Biometrics completed

3/11/2020........Case is Ready to Be Scheduled for An Interview Status Online. As of 4/13 we have not received any notifications
