I'm sorry, buy if he is a permanent resident (not citizen), he is not eligible to file for a fiancé visa. Also, if you are married - that's another reason you wouldn't qualify.

If it isn't difficult, it isn't worth it.

He's from hawaii. And he's dad also petition his mom and now his mom is hawaii already.

I'm confused your post is in k1 but you call him your husband, k1 is for fiancé to marry in America. Him being a lpr it will take around 2 years to get a visa for his spouse( my husband best friend is a lpr and he petitioned his wife earlier this year) and lpr can not do k1 at all he would have to wait until he becomes a USC

If your significant other is your fiance and a permanent resident, he cannot file for a K1 (fiance) visa; only US citizens can file for a K1 visa.

If he is your husband, your case can take up to 2yrs to get a visa because you would fall under the F2A visa category, since he is only a permanent resident. The initial i-130 petition will take up to 5 months to be approved. After that, you would have to wait for your priority date to be current before you are able to get a visa.

It's ok I'm still in the process of learning as well. My husband friend is a lpr(same as your husband) and even know he's summited his wife's application and was approved he is waiting until the priority date becomes available. Depending on your country it's around a 2 year wait for lpr. Edited to add my husband friend received the approval letter fast I think it was a few months if I'm not mistaken but he still must wait until a date can be available

Im sorry and just a newbie here. I'll update my timeline for people to understand my situation . But I have a friend who is also a permanent resident in the us and he petitioned his wife then after 2 months they receive a letter of approval.

Some people get their i-130 petition approved faster than others; it really depends on which service center your case is being processed at. Some get approved as fast as 30 days, while others wait more than 5 months. Just be patient and your time will come... besides, you still have quite a long wait ahead of you for a visa. Even though your friend got his petition approved quickly, he will still have to wait almost 2yrs for a visa to be available for his wife... and the same will be for you because your husband is just a permanent resident.

The I-130 approval is just the first step. It doesn't matter how long it takes up be approved because you still have to wait for a visa to be available for you. And the current wait is around 2 years for spouses of LPRs. So even if the I-130 is approved quickly, it means nothing. You still have to wait. Either you wait at USCIS or you wait at the NVC. Waiting is still waiting.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019
