I included a copy of expired GC but not the stamp. I had an appointment to get a stamp last October 8. The officer took my GC and gave me a copy. She made sure that I have that on my application and I have no RFE accdg to the tier 2 via phone. So I just submitted my application cause I know it will take a long time again.. I submitted N400 in Illinois servicing center. I’m not sure if they’re going to wait for my GC approval and 3rd year  (dec 31) as permanent resident before they process it.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

There are only three options:

  • Pay immigrant fee
  • Application for I-90
  • Application for I-131A

I included a screenshot of the page for reference.

You can apply and pay online right away. 

If you are not ready to submit all the documents you can always sing out and go back later on and finish it. There is a 30days window to get it all done.

 

I don’t know if it’s a glich or not but once you attach any docs you can delete them but they don’t go anywhere so be mindful of what is going to be submitted. 

 

You can track everything online, and print out your biometrics notice without waiting for the official letter in the mailbox.

I'm a November 2016 filer. i751 is still pending but am eligible to file for N400, so I will just go ahead and file it tonight. We'll see how it goes.

Hi Folks,

 

I've received my new GC today after having my I-751 approved on 10/26. However, I noticed that my new card does not include a signature, instead stating "signature waived". As per USCIS's website, they waive the signature for children, people who are unable to sign, and those who entered the US for the first time as an LPR (consular processing). However, I did not - my category is IR-6, as I went through the AOS process. Any thoughts on the matter? Do others who went through the I-751 process after AOS have signatures waived, or is this something I should be contacting USCIS about?

 

Note: my previous CR-6 GC did include my signature.

Unfortunately, I can no longer edit the first post, so double-posting a quick update: I just got off the phone with a Tier 1. After doing some research, she advised that this is not a normal situation and suggested that I make an INFOPASS appointment to discuss resolution options, which I did. However, I found at least one other case of an IR-6 with a signature waiver from VSC, from a September 2016 filer.  So perhaps this is the new norm and the instructions just haven't trickled down. I did notice that I've been seeing a lot more GCs with waived signatures in the last year (I work in HR and see I-9 docs form a few thousand people every year), but I attributed it to the expanded signature waiver announced in 2015, which does not cover IR-6. I'll pay attention to the category from now on.

 

I also wonder if this is done in preparation for the new design which does not include a signature. My card is of the old design.

I may be missing your point. Technically, the new design card simply does not include a signature; it does not explicitly state 'Signature waived' as the current design cards do. However, my card is of the *old* design and *does* include the Signature waived statement, something that is not currently expected with an IR-6 LPR category. My guess regarding the preparations to transition to the new design is based on the fact that a few such cases popped up across these forums in the past 6 months. However, this is definitely just a guess and it doesn't seem to be the case for everyone getting conditions removed.

 

Folks who have received approvals and new cards as IR-6 (i.e. you went through the AOS process as opposed to entering on a K visa and then removed conditions) in the past month or so, could you please be so kind as to check your cards to see if signatures were included?

Mines says signature wave and I came here as cr1 not K1

My understanding is that in your case, it's actually normal to have a waived signature: if you entered the US as an LPR, you went through what's known as consular processing. USCIS has been waiving signatures for consular processing since 2015. My case is different - I originally entered on an F-1 visa and maintained a lawful non-immigrant status for many years before marrying a US citizen and going through the adjustment of status process. This is why I was asking folks in IR-6 specifically.

No need to be nervous here, USCIS has been adamant that the presence or absence of a signature is an internal matter and it does not affect the validity of your card or your LPR status in any way. Here's a summary from our friends at Murthy Law. USCIS also gives a direct response on this on their website, albeit only regarding filling out I-9s.

With this said, I will still be going to an INFOPASS appointment this Monday so I can ask an officer about the waived signature on my IR-6 card. That's why I wanted to see if any other folks are in the same boat. Hopefully, I can get some responses beyond what I found via Google.
