can someone help me please

Our sponsor received mail after we sent in aos and IV packages. We called nvc and they never said anything about this.

this is what the letter said

The Immigration and Nationality Act (INA) does not allow derivative status to family members of immediate relatives. IR1, CR1, CR2, IR2, and IR5 classifications are immediate relative visa catagories. This means that a spouse, unmarried child under the age of 21 and a parent of a US citizen require their own individual petition in order to immigrate to the US

For information about how to submit a new visa petition for an immediate relative please contact the Department of Homeland Security office of US citizenship and Immigration services USCIS

Our case is almsot complete at the nvc I just want to know what this letter means because the nvc never said anything was wrong they just told us to take certain papers to interview when scheduled. my spouse myself and our child will be going to usa.

my spouse myself and our child will be going to usa.

It means you need two cases. One for you and one for the child. Two sets of documents and fees except the AOS fee where you can pay one fee for both cases. How many case numbers do you have?

my child is american citizen and hold an american passport

Then you don't need a case for him/her. Have you tried calling the NVC about this? It seems that someone there thinks the child is immigrating.

Good luck you're welcome

Hi, how do we pay that? :D

When you collect your passport with your visa on it you will get a paper guiding you the steps to pay it and as Bookman said you create a Elis Account .... only when you get back your passport then you could pay good luck

Thanks for the assurance.

That's the thing, it is not a joint form I filed out (not i-864 but rather i-864a for my brother) so is that still applies? So my brother is using me and my husband including himself in his household (3 people) and his salary for this year is close to 3 figures. however in the previous 2 years it was below the required. is that still okay?

sorry still nervous. I will be there with him for this his interview but it is Pakistan and I have heard contradictory stories.

That is incorrect. You are not included in your brothers household size. That needs to be corrected. Household size isn't who you live with its who you clam on your taxes.

Does your brother include you on his taxes? If so they you would be included otherwise his household size is 2.

Current salary and previous year is what they want to see above the poverty guideline. Don;t know what 3 figures is.

It's fine he fills out the I-864a.

My husband is APPROVED!!:dance::dance: Thank you all so much for your advice/instructions. Because of the tips I received here on VJ my husband's interview went so smoothly that it didn't even seem like an interview, according to him. They barely asked any questions. It was more like a conversation.

I'm absolutely ecstatic, and I can't wait for me and my son to reunite with my husband.

Thank you all again!

Congratulations. That's great news.
