Ok so i called NVC to ask how long after case complete before we get an interview date. The guy says usually takes 60 days to get a date then 4 weeks to interview . That doesnt sound right at all. Any insight to this?

Yes it sounds right. If you look at spreadsheet different embassies wait short times long times it just depends. Hong Kong I don't have many about it can be 2 to 3 months. They say 60 days j But like I said its all about how many slots available for that upcoming month.

I just updated 2 for UAE they been waiting since June. Imagine.

Hi,

I am a bit distraught because my husband had his interview today and was given 221 (g)form. Nothing was checked off to say that he is missing a document or two which he can simply bring. He was told that the case will be sent to USCIS. I don't know what to do at this point. I have called USCIS and they can't provide me with any answers since they haven't received the case. I just emailed the embassy but it's been nearly impossible to get a response fron them in the past so I'm not so sure if they will this time.

If anyone had went through this before what did you do and what was their reason for denial? I don't really know what to do. I am just scared if they send the case to USCIS this is going to be another long wait that I can't bear to handle any longer. Everyone's experience regarding this particular situation and suggestions are appreciated.

Sorry I am so late reading this. First I am so sorry to hear your news. Now this may be hard to hear but this is what will happen and I will have some suggestions for you.

Unfortunately your petition was denied and is being sent back. On the 221g ask your husband to see what was checked. Now I have questions for you. But first this is what happens. Your petition will sit at embassy until the pickup some embassies send back within a few months some take 6 months. It will be 12 to 18 months before you ever will hear from USCIS. Once they receive your petition and get to it (it sits just like any other petition for its place in line) they will send letter telling you they plan to Revoke or deny and send you instructions what to do.

You will either be reaffirmed(re approved) and asked for nothing. Or you will get NOID?NOIR (Notice of Intent to Deny or Notice of Intent to Revoke) and you will be given all the denial points of interview and you will need to address each point within usually 30 days get back to them and they will render a decision.

What you can do now is tomorrow get on phone and call your Senator and get them to look into it. Look up their info now and be ready.

Email the embassy ask them why denied(I am sure they will give the blanket "failed to show bonafide marriage"). Ask if you can have second interview and you will be there. Rare but you never know it has happened and worked.

Let me ask:

  1. what evidence did you submit with your I-130 petition to USCIS?
  2. Did you send extra evidence with your documents to NVC?
  3. How many times have you visited your husband?
  4. For how long?
  5. Any Red flags?

Beside getting Senator involved (all they can do is get information). There's nothing you can do but sit and wait. Sorry no getting around that. I know people denied January through Match 2015 are just getting their letters now.

Hey guys,

My wife just had her interview this morning (10/3/16 @ Mumbai Consulate). It went well and I am glad to say she was approved! Thank god. I would like to thank Visa Journey and its' members for making this process less stressful. You guys have been a great help. I wish all the luck to rest of you guys who are awaiting the same results. Hang in there. The process took a long 8 months to complete but I'm glad to say it is finally over.

Hello Vjers,

Have a question. I posted this in the NVC thread but did not get any reply.

So I sent a request for expedite and I got an email asking for some info. The only thing in the list they gave that I didn't include was beneficiary country and local phone number . So I added that and resent the request. I got the same email asking for those same things 2 'more times. I don't know if I should keep resending. Has anyone experienced this before ?

Call NVC and ask them what is it they need.

Here is the info page for your country. It hasn't been updated in 4 years. Just call the clinics and inquire. Prices went up everywhere as of October 1st.

My husband got approved on October 3rd. Should get his visa tomorrow or Thursday. Where do you check for the Green Card or does it just come to the address we provieded at the interview?

Well its not automatic you have to pay for it first. Once he gets his Visa then you can either pay the $165 fee before he comes or after he arrives. No matter.

Instructions about the green card and payment is on the 1st post.

And yes it will be sent to the address given on the DS-260.

No red flags.

They emailed me back today stating that the consular was not convinced of the bona-fide of our relationship but the thing is that the consular never asked for any documents that my husband brought that could have proofed the bona-fide of our relationship. The consular asked my husband 4 questions how did we meet, when did we meet, when did we get married and what I do on my off days. Yes the time we met was the first time ever meeting, and we got married 3 days later but we had been talking for about 3 months before that and I knew from talking to him from day one that he was my soulmate. And at that time I was also a full time student and so that was the only time I had to visit him and we decided to get married because I knew I wasn't going to be able to visit him again because of the fact that I was a broke college student. I wanted to have him close to me so I went ahead and filed for him the following month after visiting him. Is it a crime to fall for someone at any time frame even if its quick to some people and decide to get married and file paper work so that we can be togther? I just don't understand these consulars.

I sent them an email today in response to their email basically stating that the consular never asked for documents to proof bona-fide of our relationship. And funny thing is that in their email it stated that the consular reviewed the evidence presented but he/she wasn't convinced and that's simply not true. Waiting to hear their reply which I am praying for will say they will review the case again with the requested documents to proof bona-fide of our relationship. Pray for us guys. I have faith though that it will all work out. This is just another hurdle that we will soon cross.

Sorry again for the denial but here's what I see if the issue. And no its not a crime to fall in love. We are all in same boat. But its how you present your case.

Red flags you have many

1. Only meet 3 months prior to marriage

2. Married first visit

3. Age gap

4. lack of visits and duration

How long did you stay your one visit?

When cases are like this short and not alot of evidence filed at beginning it usually comes down to the interview and how the beneficiary presents themselves and answers.

How did he answer the questions? Any wrong or did he waiver?

CO's rarely will look at evidence at interview there's no time for that. That's why you have to frontload especially in tough embassies (That would include any African country).

Not visiting multiple times and duration is a big Red Flag because to immigration it may look like you are marrying only for immigration reasons.

Email them and ask for a 2nd interview and tell them you will fly in for it. Can you do that if they say yes?

Thanx MrsBurgz. I understand that could be the red flag but the fact that the consular did not ask for proof is what we are confused about. So hopefully they will reconsider and have my husband come back with whatever proof they request.

Question, what other documents could I send to my husband when they do review the case again? He has Boss Revolution phone calls from October of last year, western union receipts, I was going to send him whatsapp chats but it was just alot to put together but I will this time once they give him a date to review the documents. He has our wedding pictures as well as a few casual pictures we took when I went to visit him. If anyone on here can give me more ideas as to what they submitted to proof bona-fide of relationship I will appreciate that.

But that's the thing there's nothing that your husband would have had with him that would be proof of no more visits and short stay. That's #1 evidence Face time. You will need to make visits during this waiting time to convince a CO ya'll are real. That's just the facts.

Chats and posts and phone logs aren't proof of a bonafide relationship. How long did you stay your visit? And how long ago was it you were there?

Well since they said they are sending back to USCIS there won;t be any calling back. But let's pray for a miracle like my profile pic says. If they call him in you need to first look at what you submitted up to now. It wasn't enough to convince them so more of the same won;t do it. You need better evidence.

And No No NO do not even think about submitting Western Union receipts. It will only make your case look even more suspicious.. Were these money transfers you sent him?

You have to think like a CO and think what you need to see to be convinvced and take all emotions out of it. You know you are in love its real. A stranger doesn't you can't blame them. Get better evidence and your best is a visit and stay at least a month or more.

No we don't have anything jointly. I don't have life insurance. The items I listed I never submitted during the filing of the I-130 because I did not have enough record I thought. The only thing I submitted with the I-130 petition was our wedding pictures, casual pictures and our marriage certificate and USCIS approved it without any request for more evidence. And during NVC stage I did not send any of those items either but rather what was requested. And they reviewed and completed my application and just ask that my husband bring 2015 W2 which I forgot to submit.

I,m sorry you didn't know to front load your petition. That's was putting all your evidence up front and not bringing to interview. Like they say the interview is the wrong time to submit new evidence. USCIS doesn't care about all that they will approve most petitions with a marriage certificate.

NVC doesn't approve anything they are a document and form collection facility and just make sure we filled out everything and we have all our documents.They are there to accept and review our Affidavit of support evidence and IV package. Many people do a "Sideload" for extra evidence and when they learn they didn't do enough at USCIS. NVC will accept and add to your casefile and its sent to embassy.

The whole petition packaging process truly is to get what you want the CO to see before the beneficiary even steps to the window. Trust me the decision is already made before interview. they ask their questions and its over.

You need affidavits. For a African embassy its important especially from his side who has seen you both in the flesh together. Parental approval is vital. Pictures of parents and rest of family and friends is vital. You two together not so much. Showing communications helps but anyone can manufacture that. Like I said before think like a CO.

Don't mean to be gloom and doom its not all lost your process just will take more time is all.

Timeline

The thing with this form is it has to be notarized. Therefore the form needs original signatures and all family members involved must be "present" in front of the notary. You will also have to write the date and time the form was signed by each member so if your in-laws are located in another country, you may not be able to use them as they cannot be present in front of the notary. I used my mother, father and brother as my three members. Remember, getting the form notarized basically makes your marriage statement "authentic" and you do not want to defeat the purpose of it by raising red flags when you get people to sign it who cannot technically be present in front of the notary. Make sure the notary puts a stamp and the official seal on the form. You can find professionally written forms online via Google.

No affidavits don't have to be notarized. They could careless. For many embassies its not even considered. Cuz well who submits a bad attestament of marriage. It's all wonderful stories and testimonies of the couple. But notarizing no its not required or needed.

Here is an example of the affidavit I post many times here on VJ.

I have known of Minnie and Mickey’s relationship since August 4, 2009. I remember the date because that was when my son Mickey came to me so happy and joyous to tell me about his new relationship with Minnie. As he talked I could see instantly he was head over heels in love. I had never seen my son this happy and overcome in love before. He made me aware of her age and I was suspicious and couldn’t understand it. In fact I forbid the union and told him they could only be friends, no romance. My son turned from a happy man to a rejected former self.

As the weeks went by I saw a very sad change in my son. He wasn’t eating like he used to, talking or socializing. He was sad and moody all the time sulking around the house. I could see that maybe I had made a mistake and really didn’t know how to rectify it. I allowed their communication to continue. I really never gave them a chance. But with each phone call (everyday they called one another), I have witnessed back and forth, Mickey always texting or laughing at a text of hers and many online conversations even a few webcams, I could see my son getting more confident and happier and I know well maybe she is the one for my son.

They have continued this long distant relationship for almost 2 years. I have talked to her myself many times on the phone and found her to be a very honest nice woman. I was excited and welcomed Minnie’s visit and upcoming marriage. Once Minnie and Mickey were together face to face you could see that they were very happy and in love with each other. Since the time I have met Minnie, we have maintained an ongoing personal relationship. She surprised me with her youthful looks and energy. I questioned her age because she didn’t seem like a woman of my age. We all live in the same house and I am witness to a genuine martial relationship.

Because I have been so concerned for Minnie’s safety we have not been out and about. We have been doing all our socializing at home. Port Harcourt and mainly Rivers State has not been stable lately. Even the United States government issued a travel advisory for the Niger Delta region and asked Americans to leave. If they couldn’t leave to at least not go out at night and exercise extreme caution. There had already been two attempts to try and kidnap her while she was riding in a cab in the city with her husband. We decided it just was not safe for her to be out and about. Especially in the neighborhood we live in too many inquiring minds and nosey neighbors. But all this has not dampened her spirit to want to learn more about her new country and her new family. So we have had family members come by to wish the couple well and visit.

I have seen the marriage grow each day as they discuss, counsel and help this family with the day to day chores and living we must do. I have seen her do her wifely duties with washing clothes which is no small task. It is all done by hand. She truly loves washing my son’s clothes. She also polishes his shoes to perfection.

She waits patiently in their room daily from when he leaves around 7am until his late return sometimes after 7pm at times after 8pm. That’s 13 hours away from each other. They have a brief meal, chat and its bed. Her only complaint has been about the lack of power (sometimes we go 72 hours with no power or water) and that we all complain about. And wishing she could roam around more freely in the neighborhood like she does in Houston.

At no time has there been any element of fraud or concept of an “arranged” marriage. That is something I would have never allowed in my home. I find Minnie refreshing and energetic and have total confidence first in my son’s choice as his lifetime soul mate and secondly, I have confidence she will make my son a great and loving wife. I consider Minnie as my daughter, and I am blessed to have her as part of our family.

I hereby testify that the relationship of my name my daughter-in-law and his name my son is authentic, and that their marriage is bona fide.

I affirm under the penalties for perjury that the above-listed facts are true to the best of my knowledge.

Timeline

Hey all -

Quick question regarding delivery of visa after interview. We will be interviewing in Saigon, Vietnam. I've seen that the typical time for delivery is around 5 days. But, I have also heard that it can take up to 9-10 days. Does anybody have an idea of what to expect? I am leaning toward being safe and just assume 10 days and just hang out at the beach or something, but my wife wants to leave as soon as she gets her visa :)

Check with other s from your country. Every embassy has different timelines. They tell you at interview. Sometimes if you say you need it earlier they will accommodate. Doesn't hurt to ask.
