Hello,

This seems to be a popular issue on here, but we couldn't find quite the answer we're looking for.

RFE states:

"Submit a completed Form I-693, Report of Medical Examination and Vaccination Record, completed by a USCIS Civil Surgeon. We will NOT accept photocopied medical exam results. You must submit the original form and any original supplement completed by the Civil Surgeon to us. You and the Civil Surgeon must sign the form, and it must be sent to us in a sealed envelope from the Civil Surgeon. If the Civil Surgeon refers you to a specialist, the exam by the specialist must be included, and the specialist must complete the proper sections of Form I-693."

His medical isn't expired and he had all his vaccinations done, so I'm assuming they lost the medical or the person reviewing our case doesn't realize he's exempt because he came in on a K-1 from London. I just want to make sure I'm reading this clearly that he needs to get a new medical in the US and it's not just for the vaccinations part (we sent in the DS-3025 from Knightsbridge)- they want a whole new medical examination. Also, does this mean they want the Civil Surgeon to send them the report directly or the Civil Surgeon gives it to us in a sealed envelope and we send it in?

You still have to have the immunizations transcribed to the I-693. The medical exam portion is not required if the exam was done within past year.

Your RFE is asking for the exam and vaccinations, not just the vaccinations.

When adjusting from a K-1, you should not have to get another medical if your K-1 medical was done within a year of filing for AOS. However, some immigration officers do not seem to know the policies regarding AOS from a K-1. Some are asked for a new medical, and some are correctly not asked. You now have 2 choices: 1) Send them a copy of the USCIS policies, state your case that you are not required to get a new medical, and risk denial. 2) Comply, get the new medical and get your green card approved.

Thanks! I figured as much that's what they were asking. We'll err on the side of caution and get a new medical.

They lost our medical exam and we had to redo it in the states (entered US from Brazil via K1 in April 2016, married in April, applied for adjustment of status in May). Sucks! We did actually send them a letter at the recommendation of a level 2 officer after the first notice stating that legally we weren't required to complete another medical exam and sent them the vaccine record. Then we got ANOTHER notice that was quite demanding and we talked to several officers about it and the last one said the form was not in my husband's A-file, which means they must have lost it (according to the officers we spoke with). Super frustrating. This was about a month ago and we got our approval for adjustment of status less than a month after we sent it in!

My husband called today to try and talk to someone at USCIS to find out specifics for this and the RFE for our marriage certificate and they said they couldn't disclose information on that line and we'd need to schedule an appointment. Quite frustrating.
