Fiancee Visa Interview

Yeah...every one case of visa fraud that is discovered ruins countless legitimately loving couples...I have also realized upon talking with people and looking on visa journey and other sites...that the likelihood of being approved with the very first filed petition is slim at best...they make you prove you are serous by filing second petitions...a way of them weeding out applicants who are not serious...

Our case was rock solid. There was no reason to believe we would fail. I mean she traveled at least 3 countries with me same airline same hotel in different countries, She visited my parents stayed with them in my original home country....tons of evidence, pictures in different countries together, Multiple visas in multiple countries in both of our passports(Entry and Exit same date) because we traveled together. I mean no way we would get denied. That was a shocker when he said he cannot issue visa. I was standing there and he asked me all the questions. Interview was perfect. There was nothing wrong. That's why it was more shocking. That is the reason I believe they determine who they will pass they pre determine way before the interview. There was no reason given. Other then a generic reason they give to everyone. Which is they have reason to believe our relationship is not bonafide.

I contacted my state senator three times. Last time lawyer recommended senator get involved. The woman prepping my fiancee is a woman who is a legal assistant for my lawyer who immigrated from Cambodia ten years ago...if she does not know what questions to get my girl ready for..no one does...

When DiD you have your interview?

Did you contact senators after denial? If you did that doesn't do any good. Once case get denied then it's done. They send the case back to USCIS and senators will get that same answer from US embassy that case is on the way back to USCIS

There are countless visa frauds committed in the past related to Cambodia. If you google you will find massive visa fraud stories between 2000 to 2010. Well...I am not trying to be negative and live in the past. It does not matter to me right now! The interview does. Whays done is done! Also...some consular officers look favorable at a lawyer being involved...when a lawyer is involved / senator...it paints a good picture. Defending yourself in court when you are accused of a crime does always work out in your favor!! Also...countless people get RFE requests without lawyer assistance...

wow...thanks for getting me worried dude! How can anyone overcome this situation? I currently work in law enforcement...not sure if that helps? Also...looks like having a lawyer helps...and...if the embassy was truly "black listed" the officials would have discontinued these visas...like the did with adoption...

They cannot officially black list a country. That will be a discrimination against a whole country. It's just unofficial black listed country. There are few of them around. Cambodia is one of the toughest.

Well when there is a criminal case lawyer represent the criminal at court. Lawyer argue and talk on behalf of that criminal in front of judge. In this case lawyer is not allowed to go in with you to the interview. Only you and your fiancé need to face the interview. Lawyers are not present and not allowed. So that argument doesn't apply here. Also on RFE if you follow all the instructions correctly should be no RFE. If you read many stories here on visa journey too many people got RFE when they had lawyers. So RFE goes both ways either have lawyers or not. Based on many interviews I personally observed at the point of interview, it doesn't make any difference you have a lawyer or not. But it does make a difference if a senator inquire about you. I have personal experience and knowledge about that and I can share that if you want privately.

Well if you are in law enforcement I don't think it matters. You already found that out. Your fiancé was denied before.

It's all depend on evidence and actual physical visits. Not online or Facebook or chat logs. Also how much evidence you already submitted initially because I got strong evidence they actually pre determine before interview who to pass who to fail. They don't pay much attention to what you bring to interview. They don't have time or manpower to do that. They are conducting 25/30 interviews a day and some lasts hours.

All these warnings I am giving you just to make you prepare not to scare you. They do pass a lot higher percentage of people second time around if people do come back and apply again. I met people who succeeded on 3rd or 4th try. But they do approve most people on 2nd attempt unless there is something they suspect bad. They don't give you a chance to dispute or bring additional documents. They just take easy way out just deny if there is a slight suspicion.

Well....senator is helping...we will see...also the guy who did the first interview was found guilty of being biased after several complaints and does not do interviews anymore....so..should be good...as far as criminal cases...sure..lawyers help you in court..but not when interviewed by the cops...

Also...you are from Bangladesh...living in the USA...and you applied for a USA fiancee visa for a Cambodian woman??

I am a naturalized US citizen. Not a Bangladeshi citizen. I was born in Bangladesh where my parents still lives.

I have no idea or experience about Adoption cases in Cambodia.

Well you might have discovered the reason why they denied my wife first attempt. You just asked me how come I petitioned a Cambodian woman when I am from Bangladesh? May be that's what happened. May be the first CO who interviewed us was biased. Even though I am an US citizen, I don't look like white or black American , neither do I look like Cambodian ancestry. May be you hit the right button. Even though I had overwhelming evidence, may be he was biased though that is against the law. Different race,religion, national origin....sounds like breaking a serious US domestic law. But it goes right through the window outside the USA. They have ultimate power and can decide who to approve who to deny. Nothing you or me or anyone can do about it. And they don't have to give any reason and have no accountability.

NikaMo...Unfortunately, I have to admit..you might have a point. Doing it my self might of been better, although...it is past the USCIS stage...so compiling evidence for the interview...I have five trips worth of evidence...now whether it reaches the level of "Bonifide" evidence. Well...that is up to the consular officer. I also did take your really good advice of contacting my State Senator...and they will be compiling a letter for me to take with us to the interview (as well as...they will be contacting the embassy before I we go)...good advice...again...this does not mean that being "approved" is a guarantee...but it sure does not hurt...thanks!

Take photo copies of your passports entry and exit to Cambodia, Also visas and boarding pass/tickets. The chances of your passing interview this time is excellent. Like I said I witnessed many interviews personally over 4 different occasions. Also involved with this process for over 3 years and communicated with many other people who were going through process. Then after we were done I helped many others for last 3 years at this embassy. I don't. claim to be a lawyer because I am not and that's not my profession and I don't advise people for money. I just do it because I know the pain and how difficult it is at this embassy for real couple like us because of some corrupted people abused the system. I know for fact lawyers help is completely useless at this embassy but they try to tell people otherwise because it's their precession and they have interest in it to make money. I don't so I can tell the real story. Lawyer will tell you if you pass interview because you had lawyer and tell you you answered something wrong if you fail. Believe me I know this game of lawyers. My wife came with me to USA 3 years ago. Since then I helped and advised countless people. I heard it all. One thing I can tell you for case like yours who are going through 2nd time and also asked for senatorial help. I have not heard any failure of visa interview among them so far.

Awesome! Like I said...there are a few misspellings, which is irritating me...but the overall evidence is pretty strong...also included a letter of how we met, and what we did on my five trip to Cambodia.....mother communicates with fiancee regularly, and I have those records as well (if needed). My mother submitted a letter at the I-129F petition stage....taking a mountain of evidence. In the I-129 Packet, I did submit the passport photos and visa stamps...but did not submit the photo copy of the stamps of entry / exit, although...should not be an issue (I hope) because my flight itinerary shows when I arrived and left. So many things are different this time around.....hoping it is all enough??
