It would be extremely unwise to rely on the baby as proof of entering the marriage in good faith. Financial comingling and other evidence that proves an intertwining of lives would be better.

So you tell me which one is more a genuine marriage look to you ? Having a baby, joint accounts, pictures having vacation? Again some ppl will chime in just like you and my advice don't chime in if you have nothing good to say. Your just letting the person more stress or sad in the time they needed help most.

Since the OP has already a conditional GC, I believe she convince the CO that the marriage is genuine by the evidence that she submitted right? Since she got pregnant and 100% she will not have anymore evidence after the divorce, at the time when she will finally apply to remove conditions the only thing that she can provide as proof is the baby, now she can probably submit the previous evidence that she entered the marriage in good faith. But the CO will be the verdict at the time she will apply for ROC.

The best option you presented was the financial one. Having a baby is not strong evidence of a genuine relationship. I'd bet there's a lot of people in your world who've gotten pregnant less than one month into a relationship. As a result, she'll need more than a baby as proof. And as for already proving a genuine relationship, when was that done? If she came on a k-1 the only "evidence" you have to submit is your wedding license. That's all my husband sent to get his conditional green card and we didn't have an interview.

You basically chime in without reading what OP need help, she already said conditional GC. My advice is not false and not incorrect and inaccurate. My advice is very helpful why? because when my gf got pregnant here at US and we are not married at that time, also I can't add her to my insurance and guess what I applied her a gov health insurance and she got approved. Suggesting to the OP that the baby is the proof she entered the marriage in goodfaith well its up to the CO or whatever evidence that she provided when she applied for a green card. Don't be a wise a**

We all know that many people come to the USA to have babies to gain citizenship for the baby. Although this does not appear to be the case here, because it DOES happen, it can never be relied upon as "proof" that a marriage was genuine. My husband and I cannot have children. Are you saying our marriage is not genuine because we don't have children? What if a couple doesn't want children?

Having children together is a choice that some couples make. Not all couples make that choice. It is not something that is expected of couples, whereas joint finances, co-mingling of assets and sharing a lease ARE things that are expected of couples.

Instead of advising the OP that she is fine because she has a baby with her husband, it's better to give her advice on things that WILL matter when it comes to ROC with a divorce waiver.

OP,

If you divorce and want to stay you can. You need to Remove Conditions by yourself with a divorce decree as already advised. To remove conditiosn with a divorce waiver you still need to provide evidence of your relationship for the time you got married, to the time it ended. Please read the guidelines.

Do not relay only on your baby as proof, you will also need financial and all other evidence as a regular ROC. The instructions clearly state that you should add all your evidence AND birth certificates of the kids from the marriage if there are any. If having a baby was sufficient proof of good faith marriage then USCIC would not ask for anything else other than birth certificates if you had kids with your spouse already. So make sure you gather all evidence possible.

Ultimately you will be ok as long as you follow the guides and provide them with what they need. But please do not rely only on a baby as mentioned before here.

If she does not want to or can not stay in the US, best to leave before the birth. Otherwise she will be in PI and potentially the baby in the US.
