Timeline

Thank you everyone. I have no reason to stay in the US because I moved here to be with my husband. Nothing ties me to this place, no friends or family. I was already looking into talking to a lawyer but I couldn't pay one. Im a stay at home mom. The baby doesnt have Romanian citizenship yet, but we're working on it before anything else. His dad said he wants to be removed from the baby's romanian birth certificate. If I leave I dont want child support or anything, I can take care of him myself

It is a shame that you didn't get citizenship yet.

If you really have no interest in having him further in the baby's life and he doesn't either and you never want to pursue him for child support, I suppose you both could have the court terminate his parental rights. It is probably not a DIY thing.

Especially if he doesn't contest it, it might be very possible to file for sole custody without a lawyer. I probably could have done my case after seeing that almost everyone else at family court was pro se and it was a pretty easy case. Had my ex fought it, I would have been glad to have that lawyer, though.

I wouldn't discount getting child support in the future. I decide to pursue my daughter's when she was close to a year old after saying I wouldn't. It comes in handy (covers her braces payment at the moment).

You said you could not afford to see an attorney, I am here giving you a free legal advice (I am an attorney).It doesn't matter if your child will leave the U.S using a Romanian passport, your child is a U.S Citizen and leaving the U.S. without setting up your child custody is not smart, to say the least.

Today your husband is all ###### up but if later on he changes his mind and accuses you of parental kidnapping you will be in trouble. People change and circumstances,for good or for bad.

While you may feel you can say "well we had an agreement". When it comes to child custody, there is no enforceable agreement UNLESS it's on paper. So you can say "well he said!" all you want, if you don't have a paper to prove that is what was said, then you can get in some big trouble if he pulls the parental kidnapping card. He could straight up lie about it "well she said she was going to visit and never came back!" but without you, the person with the child, having documentation that you could infact take the child and custody worked out, you have no ground to stand on if he claims you kidnapped the baby.

Set-up child custody else you could be accused of child kidnapping and it could get really ugly really fast for you. Good Luck!

I never said I would leave without anything. I wouldnt leave without anything. he said he wanted to give me a notarized declaration stating he allows me to take the baby out of the country and give me full custody. I dont trust any man or woman when they just "give their word". For now Im working on his citizenship one thing at a time
