Call Uscis and change it from cr1 to spouse visa a little more money but a lot less time!!!

CR1 is a spousal visa. Even if he does get a visitor's visa, he will have to leave again for his medical and interview in his home country and then wait until visa issuance if approved... he doesn't get to stay in the US.

Statement doesn't make sense.

Ok, Contact the USCIS 18003755283 and inform them that you would like to change your petition to a spouse visa. K3.

So what you have to do is after you get the I -797 (NOI 1) make a copy of it and file I-129s (it's free)

CR1 is a spousal visa. Even if he does get a visitor's visa, he will have to leave again for his medical and interview in his home country and then wait until visa issuance if approved... he doesn't get to stay in the US.

I Know that

You can certainly try the K3 route, why would you though, especially this far in.

Oh, apply for the K3? The K3 becomes void once your I-130 is approved. At this point we are already four-and-a-half months into our petition being with USCIS, so that doesn't do me any good. I appreciate the suggestion, though!

You tend to argue with those who are helping you. However, nothing beats a try----Good Luck

When both petitions have been approved by USCIS and sent to the NVC or when USCIS approves the I-130 before the I-129F, the availability of, as well as the need for, a nonimmigrant K-3 visa ends. If the NVC receives both an approved I-130 petition and an approved I-129F petition:

  • The nonimmigrant K-3 visa case will be administratively closed.
  • The application process explained below will not be available to the foreign-citizen spouse and cannot be used.
  • The NVC will contact the U.S. citizen sponsor and foreign-citizen spouse, with instructions for processing the IR-1 (or CR-1) immigrant visa.

I know this you can only apply for a K3 before you get the NOA 2. That what i was told by USCIS. My friend did it.
