K-1 affidavit

I'm currently uncertain about whether I should apply for K-1 or CR1. I've known my boyfriend since we were kids as I lived in the US during my childhood. We are planning on getting married next year and I'm undecided which route to take. I'm considering the K1. My concern is the income requirement. Would the London Embassy accept an affidavit from a family member in the same household who earns above the 125% threshold for K1? He earns above the threshold for K1, but I worry about getting denied as its below 125%. If filing CR1 is a better option, then I will go for that instead.

Either way you need a joint sponsor that meets the 125% requirement. The CR-1 requires the I-864, which requires the 125%. The K-1 visa itself requires the I-134 and London would probably accept 100% for that, BUT after you are married in the US you will file for AOS, and then you will require the I-864 and 125% anyway.

Thanks. Sorry didn't realise I made so many duplicate posts. I'm still trying to work out how to use this site. Would the joint sponsor be accepted for both K1 and AOS?

Yes, if you have one that meets the income requirement for their own household size plus the intending immigrant.

Regardless of whether you do a K1 or CR1, the 125% issue will still be there for you.

If doing a K1, London will only want to see the financial sponsorship form from the cosponsor (if using one) and any supporting financial evidence. This is brought to the interview.

However, for AOS the USCIS will want to see the financial sponsorship form from both the joint sponsor and the sponsor (the US spouse).

Using a cosponsor is no problem, provided the cosponsor makes enough including their own household + immigrant and the cosponsor is willing to understand and accept the responsibility of doing so and what it entails.
