Hello all!

So my husband filed for his adjustment of status July 15th, 2016. He filed the whole packet which includes working papers, aos, and advanced parole document. We received all 3 I-797's for the applications and he went for his biometrics for aos and working papers on August 18th, 2016. He doesn't have a license so we took him to DOT to get his permit about 10 days after he went and had his biometrics done. DOT personnel said they couldn't issue him a permit because his biometrics weren't even in the system. The gentleman that was helping my husband at DOT was an immigrant himself and said that he totally gets what's going on. He said come back in a week and we'll see what's up. We came back almost a month later (this past friday which was September 23) and still nothing on the biometrics. But when we went online to see what our case statuses were on everything, his working papers (which require biometrics) and advanced parole document were successfully approved the same day (September 23rd). Nothing is being done with the adjustment of status though. It won't even show up on USCIS's website. My questions are this:

A) Don't they need biometrics for the working papers? How did they pass the working papers if the biometrics aren't even in the system?

B) When do they start working on adjustment of status? How long does it take for them to process the papers?

Can't comment on Pennsylvania, but I know in Michigan we actually needed an immigration document (I94/EAD/GC) to get my wife's DL. I would suggest waiting until you have the EAD in hand before you go back. As to the biometrics in the system, if the EAD is coming, then biometrics are complete. I don't know why Pennsylvania can't see them, but it might be due to them trying to access a federal system.

Good Luck!

That's what it's starting to sound like with what we might need and all. But I even had the I94. We had to take in proof of marriage, the biometrics request sheet that was stamped by USCIS saying he was at the appointment, proof of residency, social security, his passport, K1 visa sticker...I think that's it. But damn it's getting complicated now. They said we could send all of that stuff into the government to try and get the info in the system for his permit, but the nice gentleman that was helping us said DON'T DO IT. Send it in through Harrisburg and then to USCIS. They told us it could take up to 12 weeks :( like what the heck...It gets so disheartening sometimes.

Here is what I found on the Pennsylvania DMV website. Before I quote here is the link: http://www.dot.state.pa.us/Public/DVSPubsForms/BDL/BDL%20Publications/pub%20195nc.pdf

He will need under the column "Applicants for AOS":

1.Social Security Card

2.2 proofs of residency

3.Immigration documentation about status (I-797 for I-485)

4.EAD or valid passport

This is everything that I needed as well. I guess you could go back with the passport and see if they do it and even tell them what is on the PA DMV website. If they don't budge go back when you get your husband's EAD.

Sorry that you are going through all this trouble.
