I-864

Hi everbody,

I'm brazilian and just got married to an U.S Citizen. We are fillin up all the paper work for the immigration but we got "stuck" filling ud the form I-864. My husband was in school last year and just started working last february. My question is if I am gonna need a Co-Sponsor because he was not working last year even so he is working now?

In any event, there are Joint Sponsors and there are Household Members, but there is no Co-Spnosor".

I am assuming you are looking at the I-864 for the immigrant visa, not the K-3 where an I-134 would be the support form to use.

If your husbands last tax return does not meet the poverty guidelines, then yes you will need a joint sponsor, or if there is a household member where their income could be used to meet the poverty guidelines on your husbands I-864. Have a read of the Affidavit of Support guidelines which are pinned in the Immigration News forum.

Not necessarily. Current income, and the sustainability of that income, is the most important factor. The details of the current employment may be the deciding factor in whether or not a Joint Sponsor is required.

Insufficient past income can be a negative, but having been a student is not as big a negative as having been out of work for a while when one was available for and wanting work.

And there's always the possibility of assets making a positive difference.
