Hi VJ,


I am Terrymoore, I had my K1 interview done 2 months ago, precisely 21 July 2016, i was given the 221g letter, that they found me ineligible due to lack of compliance with the Immigration and Nationality Act (INA) . Below is what was written on my 221g letter:


Dear Petitioner,


Weare unable to issue a visa in the above mentioned case because the applicant has been found ineligible under section 221g of the INA. This section prohibits the issuance of a visa to anyone whose application does not comply with the INA.


Unless revalidated, I-129F petitions are only valid for four months from the date of the last action by the USCIS or C.O. We are not able to revalidate the above case file and will return to the NIC . Because the petition will have expired by the time the USCIS office receives it, USCIS will not reopen the case. Please do not contact this Embassy orr NIC regarding this case.


Note my Interview was done in Accra, Ghana.


Please guide me on what to do next because recently i checked my status on the ceac.state.gov site and it still says my case is ready for interview, please its been 2 months now, i need advice on what to do next.

I don't believe there's anything that you can do other then refile K1 or do CR-1 (this is a better option for most people). Did you have any red flags or did you have any feedback on the questions that were answered wrong? How did the interview go?...I'm guessing the expiration was a random reason that they are pinning on you to deny the visa and something else wasn't convincing about the interview. Generally, the consulate is supposed to extend your petition once they approve the case- only consulate has that authority.

Thanks for your honest response, Actually it looks as if my case was aready denied before my interview was carried out, my interview lasted for just 5mins, and she pulled the 221g letter and signed it. Well talking about red flags.... I am African, 34years old while my fiance is 57years old. Below were the questions asked:

1.How did you met your spouse, where and when?....

2.who paid for the visa fees...... we share the expenses she handles the U.S end while i handled the one here in Ghana

3.How much i earn monthly?

4. where do i work?

5. my sons age, he is 5years old now.

6 people in the photo album with us.

7. If i have sisters and brothers

8.what they do and where they are right now?

9. how long have i lived in Ghana, i have residency at as then. i have never lived illegally.

10.was my spouse properly divorced.. of cos yes.

11. where does my spouse live

12. Names of people in the photos with me and her.

Now if all this stated above are red flags, then what guarantees that a CR1 will be approved, i just dont know what else to do to show that my relationship is real and there is intent of marriage. If they can call my relationship with a lady i have come to love for 3 years a sham what then will they say about our marriage when we eventually file for a CR1.

I hope that you corrected the officer at some point, saying that it is not your "spouse" but fiancé. Don't think this might've been the problem but in a country like Ghana where you have to watch out what you say and they try to ask trick questions at the interview I would advise to correct the officer.

LOL.... married before? Naa i have never been engaged before now how much more getting married, arguing with a C/O is like pouring water on a stone people, coz i was asking the reason for my 221g, she said no intent of marriage was found, so i asked her, what am i to show or prove to her that we intend to be married within the 90 days period, she kept silent and wanted me to move away while she attend to another applicant. I wont be so worried if my fiance will like to relocate to Africa, if anyone can leave their present country is me, she is fragile and have been sick since the news of my denial. Lets be factual here, once i get married to my fiance and still face this kind of delays it will make my fiance go insane and what is a wedding with out us living together as couples. I was told i cant even go over to visit her coz i have ties to an american citizen already and fear that i will, might, or may not return. so saddening. Anyways, thanks all for your candid opinions.

Did you bring an updated letter to the interview saying that you were both still free to marry and that upon your arrival to the USA that you would get married within the 90 days?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am sorry you are going through this. Ghana is a very tough embassy and there are many on here who can relate to your situation.

I have a few questions. 1) What evidence did you fiance submit? 2) How many times did she visit you? 3) Has she contacted one of her Congressmen or Senators to get the reason you were denied from the embassy?

Unfortunately, often denied K1s are sent back to the US and left to expired. Sadly, you won't hear anything back about your case. The best thing you can do is to reapply...probably for a CR1. If you read the Ghana forum, it's not advised for couples to reapply for a K1 as often you will be denied for the same reason. I know being married and living apart isn't ideal....I am doing it right now...but it's what is necessary if you want to be with your fiance.

That said you must first find out why you were denied. It doesn't do you any good to reapply if you don't address the concerns the consulate had in your case. Your fiance should contact a US Senator or Congressman to send a letter to the embassy on your behalf. The embassy should hopefully give you a response the reason they put down for your denial. I will be honest the age gap is probably an issue for them. I know many couples where the woman is older than the man and they were denied. Since its not a cultural norm for older women to marry younger men in Ghana, its a red flag for couples there.

Again, I am sorry you are going through this. A denied visa is a very emotional and difficult thing to deal with.

Your contribution has been the best so far, and i will do just that, i will have my finace contact her congress man to help find the reason behind my denial.

My fiance keep falling sick whenever she comes to visit, so Africa is a no go area for her for now, she will have to return to be married, it has always been my dream to have my family present at my wedding, this could be a sign too for me. but i will see to it that i have her pull the reason for my denial. thanks so much all of you, V J you the best

Age was never an issue. ..

Age is an issue for many with Ghana and other high fraud embassies.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

10.was my spouse properly divorced.. of cos yes. Youe spouse ? She is your fiance. You were tricked if you did not object the term "spouse"

11. where does my spouse live FIANCE. If you did not correct the term then they will assume you are married and not eligible for a fiance visa.

Now if all this stated above are red flags, then what guarantees that a CR1 will be approved, i just dont know what else to do to show that my relationship is real and there is intent of marriage. Nothing you can do. The returned petition will expire and your fiance has to travel to Ghana to marry you and file a I-130 for a CR1

visa. As was asked before did you bring 2 freshly singed intent to marry letters ? Did you submit chats showing you were discussing your

future wedding and marriage ? Did she front load the petition ?
