Your opinions and advise are greatly appreciated on this topic...

My wife decided to come to the US on her tourist visa while I send in the I-130. Is it even worth it to file for the I-129f since she will already be here on her tourist visa, or would it be wise just to file the I-130?

It is possible that her tourist visa will be stamped for up to 6 months, and then she will return for the consulate interview for her green card. Do you think the I-130 could get over to her consulate in Poland in 6 months?

Thank you!

Has she already received her tourist visa? I know in Poland its very hard to get one, and I imagine that she would need to show ties to Poland and being married to a USC would show immigration intent, wouldn't it? I say be very cautious at point of entry. Not being prejudice, just speaking from family experience, but I'd recommend if she does go the route she chose to not fly LOT Polish airlines, because immigration officers are a bit tougher on a whole plane load. Maybe try British or Swiss. Good Luck.

Hi,

Yes, she has had her tourist visa for 4 years, and it is a 10 year visa. She is looking for a flight other than LOT anyway.

I think that if she gets approved entry for 6 months, then why even bother filing for the K-3. I have read on this forum that the I-130's get approved within 6-9 months anyway. Please correct me if this isn't the case.

Hi,

I can't give you info on the K3, because I'm in the K1 boat right now. But if she has a 10year visa, then its a whole different story, she'll be ok. They usually stamp in 3-6 months into her passport, but that can be extended up to 1 yr once she's here.

I think that your understanding is correct.

There would be little benefit to your family in filing I-129f for a K-3 visa if your wife is in the US on a B visa.

Remember that after I-130 approval there are several steps yet that take "some time". See the NVC Forum for details.
