Hi, everyone.

I came to U.S. on K-1 visa in March, got married in April and then applied for AOS in June.

I just received my 2 years Green Card on September 16th.

Everything was correct, except my NAME on the 2 years Green Card.

I applied AOS I-485 by using my Married Name.

Yet, my Green Card has my Maiden Name on it.

My SSC and EAD cards are both with my Maiden Name on them.

I have several questions for someone who has similar experience with me.

Questions:

1. Should I just keep using my 2 years Green Card with my Maiden Name (which matches my Passport Name) on it?

Or should I apply for a new 2 years Green Card with my Married Name on it?

2. If I apply for a new 2 years Green Card with Married Name on it, how long will it take?

It would be great if you could help me. Thank you very much!!!

Or should I apply for a new 2 years Green Card with my Married Name on it? It it were me, and I had properly ordered it to be in my married name, and it arrived with my maiden name, I would send it back, using the Form I-90 Process. Since it seems to likely be USCIS error, there is no charge, otherwise it may cost you $365. To assist in processing, be sure to include the paperwork that the card was attached to when you received it.

2. If I apply for a new 2 years Green Card with Married Name on it, how long will it take? That is the million dollar question, some folks wait for up to, or more than a year to receive their replacement cards. YMMV.

It would be great if you could help me. Thank you very much!!!

This morning I called USCIS and told them about my situation.

I am going to fill I-90 and send to them with my error green card.

And hopefully it will not take too long for them to send a correct one back to me.

You are most welcome.

If you don't already, I would be sure to make a photocopy of every shred of paper and documentation that you send or receive from USCIS. Stuff has been known to "disappear," or was never received by USCIS.

For example, you are a US Legal Permanent Resident (LPR), the document that attests to that is your Form I-551, 2-year conditional Green Card (GC). Having a copy of a GC with the incorrect name, while USCIS is correcting their error, is better than not having a copy of anything at all. :idea:

Hopefully, it won't take long for USCIS to produce an amended GC with the correct information.

Good luck on your immigration journey.

I just sent my package for I-90 to USCIS today.

I took copy of the documents that I sent to USCIS, especially the incorrect Green Card which I am sending back to USCIS.

It was almost impossible for me to contact with them directly though the custom service number yesterday.

So I talked to the USCIS custom service by using the website below, which was really useful.

The custom service told me that:

1. Things I need to send them Part 1

I need to send Form I-90 with supporting documents (Such as Identity Documents, USCIS Notice and other supporting documents such as, marriage certification etc.)

2. Things I need to send them Part 2

Along with Form I-90, I need to send back the incorrect Green Card and !!!A letter explain that due to DHS error there is incorrect information on my green card.!!! The letter is to insure that I do not need to pay for their mistake.

3. After sending my I-90 package

After USCIS received my I-90 package, they will send me a notice. And !!! I can call USCIS custom service again and tell them, so that they can fasten the process !!!.

→I am still having doubt with what that operator told me about No.3 information, but I will go ahead do it when I receive notice from USCIS.

4. How long the process will take

I called custom service twice. The first operator refused to tell me how long it might take for them to correct my green card. The second one told me frankly that they are really behind I-90 applications, so that it might be 6 - 9 months before I can get the correct green card. (Really Bad News)

5. About my present identity

I received my correct EAD card about 2 weeks before I got my incorrect Green Card. During those two weeks, I did not get a job or driving licence before my incorrect Green Card came. So, at this point, my EAD card is invalid (The custom service operator told me this), I do not have Green Card.

6. About getting driving license and ID card

→The Florida DMV required me Green Card/ I-485 NOA to get a driving licence. They did not accept my EAD card. I think I will try again to see if I can get any luck with DMV.

7. About getting a job

In order to find a job, the custom service operator told me to go to the local USCIS office to get a temporary stamp I-551. Yet the operator frankly told me that it depends on the company that if they would accept temporary stamp I-551 as a prove for hiring me. (Really Bad Bad Bad News)

Wish my correct Green Card can come soon.

Wish I can get driving license and job without problems!!!
