Hello all,

My fiance and I applied for the K1 visa last year (2015) and were denied at the interview at the Lebanon Consulate. He was not given a fair interview and the reason we got denied was not clear. Due to many circumstances, we were unable to meet and get married. We decided to reapply for a K1 visa in hopes that we would get approved this time. Our previous application took a total of 9 months from when we submitted the I129F petition to the interview.

We submitted a new I129F petition on March 17th 2016. We have still not received the NOA2. Because our case is now considered out of normal processing times, I submitted an inquiry to the USCIS and received an email from them saying:

"We have placed your case on a processing hold because the required security checks remain pending. Until we receive the results of these security checks, we cannot move forward on your case. We require the results of security checks before we make a decision on any pending case.

We cannot predict when we will receive the results of these security checks. Please be assured that we will make every effort to make a decision in your case as soon as the security checks are complete."

I am confused as to why the security checks are taking so long considering we have applied before and my fiance is the same person. Nothing has changed in our application. Has this happened to anyone before? I understand that all immigrants coming from Syria are under high scrutiny, but I dont know how much longer we are going to have to wait. We love each other and just want to be reunited and start a life together. I have already contacted my state senator and congressman in hopes that they can assist us.

Any advice would be greatly appreciated.

Because of the high risk and currently immigration is under intense scrutiny you are going to face many delays. Keep your dream alive. Be proactive. Temper your journey with patience. This is not going to be easy.

New application new checks, and obviously coming from that area they have to be both thorough and are very difficult to do. Quite how they can be undertaken at all confuses me.

Begs the question what has changed since your last refusal? Why are you expecting a different result.

Make sure you email or write to keep the application alive / they have to hear from you or they will let it die

you are going thru necessary security checks as they say for the area finance comes from

Did you indicate you never met in person?

Or just not able to meet to marry?

If you have not met, you will again be denied as this is a requirement

The checks at the petition stage would seemingly be of the petitioner, not the beneficiary.

Perhaps the previous petition and interview result are being scrutinized.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My fiancé and I are going through the exact same thing. He is Iranian and this is our second time applying after the denial. We had met only once before applying and were denied. In retrospect our application was not so strong and we did not supply enough proof of our relationship. This time we did a much better job and had another visit. We also filed in mid March. Our application was received on March 14. After waiting past 5 months we requested a case inquiry in which we received the exact letter you did.

Nothing has changed since the first application yet this time is going though a whole different level of scrutiny. I cannot imagine why it takes so long. I'm all for a security check with everything happening in the world but this seems crazy! After reading your post I guess it is because we have resubmitted the K1. Did you contact ombudsman, senators and congressmen? I did... The only person who responded so far was ombudsman telling me they would look into it.

Private message me so we can keep in touch. I will be praying for both of us to get through this.

Since submitting our application we visited another time and I'm heading next week to visit again. This waiting is simply awful. I strongly suggest you do the same if at all

Possible. I can understand not wanting to travel to Syria but there are places you can meet- someplace your fiancé can travel to and that is safe for you! It will help you both!

I read somewhere it can be both. If it's me then you would think it would go faster since it's much easier to check me out than my Iranian fiancé. And, why would the second apllication go through this but not the first? It's making me crazy and I wish they would just tell us what's going on. It is incredibly stressful. ???

Hi everyone, I'm Goin thru the same situation, filed for my fiance on April 2016, my case is on hold due to security check, my fiance is in dominican republic which is not high risk country, never been to usa and doesn't have no bad record, same as myself clean in every aspect and I'm going thru security check issue, very stressful situation because there's no time for this problem to get resolve, I get its just bad luck with some of us.. Has anyone here got approved after the security check???
