Hey guys. I need some help please.

I received a request of evidence and have a question because uscus isn't very helpful.

So i got an request for evidence for my form I-485. They need more evidence of my husbands income.

It has three check marks and it tells us to submit ALL of the information below, failure to do so will result in a denial.

Ok so the first check mark is asking for pay stubs for the previous 6 months, evidence of other income and a letter of employment. We got that done

Second check mark is asking to send in supporting tax documents for the most recent tax year.

Got that done.

So the third and last check mark is asking to obtain a joint sponsor.

My question is if we really need to have a joint sponsor if we can prove with the first two check marks that my husband makes way more than the income requirement.

It says it really clear at the beginning to send all the requested documents but I was wondering if any of you guys had the same case.

Thankful for any response. This is driving me nutttttssss!

Did he/you fill out affidavit of support and added all the needed documentation initially with AOS package?

letter of employment, pay stubs and tax returns should be more than enough if it is more than your state's poverty guidelines for his household size

If you have the 2015 tax transcript and last 6 months of pay stubs, AND your current annual income meets the requirement, then you should not need a joint sponsor. You could include a statement that the USC petitioner/sponsor's current income meets the requirement for sponsorship for their household size, and add in a letter from employer as well. You can even add in 12 months of bank statements with all the paycheck depostis highlighted, just for extra proof.

Usually an RFE will state that the most recent tax return needs to be submitted, and if that was missing to begin with, the RFE will always state that the income does not meet the requirement, even if it does. It is typically a boilerplate letter, and will ask for assets or a joint sponsor, but never says you MUST provide those. Not sure how yours read, but from the way you are wording it, doesn't sound like the typical RFE for missing tax return.

Is the job new? Is it from self-employment? Did they meet the requirement for 2015, or the 2 years prior(was the income stable and ongoing)?
