My fiance is in Namibia and i see per the k1 instructions it asks for two passport pics and her signature on the g325a document. Can she just email these or must the pics be regular passport pics? Must she actually send these things via mail?

Also on the k1 instructions it talks about "if your fiance is currently in the US"...can she not just stay here and we do the k1? She has a tourist visa that gives her 6 months each visit...

just to be safe make sure your passport pics are 2in by 2in , if there bigger than that size sometimes they give ppl RFEs, some sixes they accept , some they dont

Yes, she should mail the necessary forms that she needs to sign along with the actual 2x2 passport style pictures on photo paper, a regular picture emailed and printed out on your printer will not fly with them and will get you an RFE. Also, you need to send wet signatures, so an email with her scanned signature is not what they want and will get you an RFE generally.

Just to clarify a bit, The Dept of State provides a free passport photo tool on this page https://travel.state...tos/photos.html

If your fiance can take a digital photo against a proper background based on the requirements stated in the above link, she can do her own and email that to you and you could then print it out on photo paper if you have any or take it to really any photo department in say Walgreens, CVS or Walmart and get a print made. Just make sure they don't change the size of it to print to fit as it will enlarge the photo.

We did ours this way and just took the digital copy on a flash drive to Walgreens and had them print off several as you need several.

In regards to her staying here to do the K1, no, she can't stay here to do it as she has to do her interview and medical in her own country. She is allowed to visit while the K1 application is pending but she has to return to her country to complete the steps necessary for the K1 Visa.

Did you actually do a k1 or AOS while here? And why, then, if my fiance could not apply for k1 while here would it specifically mention that in the instructions for the k1?

It appears as tho AOS while here visiting is the easiest way for my fiance to get her papers here. Why? well she already comes here to visit and we can legally marry here. The k1 simply gets her here and we need to apply for AOS anyways. Why must we sit around and waste time on k1 when she is already here visiting?

We started with the K1 process and did the AOS once he got here on his approved K1 and we got married. You can start the process while she's here, i.e. submitting the initial paperwork to get the ball rolling but she has to return to her home country as they have to go through the interview at her country's embassy and the medical has to be done by a board approved dr. over in her country by her country's embassy. This is just how they do it so she would have to go back to complete the steps needed for the visa.

If she is already in the US today visiting and had no intent to marry and stay when she entered, and you decided to get married tomorrow and file the AOS/EAD/AP paperwork, you legally can do so; however, she will not be able to leave the country until you get her greencard and/or approved AP (which the AP doesn't guarantee that they will let her back in) and she will not be able to legally work until she received approved EAD (authorization to work).

Now if she is NOT in the US but comes over on a visitor visa and has the intent to marry and stay, that IS illegal and considered fraud which would be why you wouldn't want to do that.
